{"id":570925,"date":"2023-10-20T10:43:22","date_gmt":"2023-10-20T09:43:22","guid":{"rendered":"https:\/\/ais.al\/new\/?p=570925"},"modified":"2023-10-25T10:47:17","modified_gmt":"2023-10-25T09:47:17","slug":"public-procurement-in-albania-matters-of-practice-and-legislation","status":"publish","type":"post","link":"https:\/\/ais.al\/new\/en\/public-procurement-in-albania-matters-of-practice-and-legislation\/","title":{"rendered":"Public Procurement in Albania &#8211; Matters of Practice and Legislation"},"content":{"rendered":"\r\n<p>Presentation by: Aranita BRAHAJ, Executive Project Coordinator<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>Viktor GUMI, AIS&#8217;s Legal Expert<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>October 19th, 2023, h.13.00.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>AIS&#8217;s commitment towards Transparency, as well as Improving Accountability and Dialogue within the Cluster 1 negotiation framework.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p><a href=\"https:\/\/ais.al\/new\/en\/\">AIS<\/a> is a local organization founded in 2011, best known as the promoter of Open Data Albania, working on Transparency, Accountability and Good Governance.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p><strong>SIDA Support and Partnership. <\/strong>For the March 2021 \u2013 February 2024 period AIS is implementing the <a href=\"https:\/\/ais.al\/new\/en\/open-data-access-and-transparency-over-sectors-exposed-to-risks-of-corruption\/\">&#8220;Open Data Access and Transparency over Sectors exposed to Risk of Corruption<\/a>&#8221; project. Supported by the Swedish International and Development Cooperation Agency, SIDA.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>Focus: Open Data, Evidence Based Approach and Anti-Corruption.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>AIS has contributed to fostering dialogue for better public policies through Research Articles; Publications, Litigation and drafting of Policy and Position Papers.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>AIS is working with young people through its <a href=\"https:\/\/ais.al\/new\/en\/?s=youth+network\">OpenDataFellowship Youth Network<\/a> on educating, capacity building, as well as internshiping the fellows on articulation and public debate based in facts and data.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>AIS is part of a Consortium of 4 Local NGO-s, aiming to Improve Policy Debate and Accountability in the Fulfillment of the First Group of Negotiating Chapters Cluster One, <a href=\"https:\/\/ais.al\/new\/en\/c1-eu-npa-improved-policy-debate-and-accountability-to-delivering-on-fundamentals-first-through-the-establishment-of-cluster-one-eu-negotiations-platform-albania-c1-eu-npa\/\">C1-EU-NPA<\/a>.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>AIS and IDM are local partners with Transparency International in the implementation of the Project \u201cEU4Rule of Law: Citizens Engagement for Public Integrity (CEPI) in the Western Balkans and Turkey\u201d.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>Download document <a href=\"http:\/\/ndiqparate.al\/wp-content\/uploads\/2023\/10\/Public-Procurement-Albania.pptx\">here<\/a>.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>AIS has built digital databases, based on the Open Data Standards, which have enabled the empowerment of public actors, through easy access to information and facilitation on the monitoring of the public sector (<a href=\"https:\/\/spending.data.al\/sq\/treasury\/list\/year\/2019\">expenditures<\/a>, <a href=\"https:\/\/openprocurement.al\/\">procurements<\/a>, <a href=\"https:\/\/openprocurement.al\/\">contracting<\/a>, <a href=\"https:\/\/spending.data.al\/sq\/moneypower\/list\">asset declaration<\/a>).<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>Open Procurement Albania.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>For each tender we create a <strong>Passport<\/strong> containing information on the tendering procedure, by the first notification till at the Budget payment. The passport lists all the Tender Documents (the institutions stop publishing\/advertising the relevant tender documents after the finalisation of the tendering).<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>The <strong>information<\/strong>, distributed by institutions is closed formats pdf, not consistent in time and not integrated or comprehensible to third parties.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>The <strong>AIS team <\/strong>collects and gather all documents, data and information regarding a Tender and creates the integrated tender PASSPORT according to the Open Contracting Standard.<\/p>\r\n\r\n\r\n\r\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" class=\"wp-image-20123\" src=\"http:\/\/ndiqparate.al\/wp-content\/uploads\/2023\/10\/Screenshot-2023-10-18-142114-1.png\" alt=\"\" \/><\/figure>\r\n\r\n\r\n\r\n<p>&nbsp;<\/p>\r\n\r\n\r\n\r\n<p>In the end, an <strong>algorithm for risk assessment<\/strong> makes it possible to mark with a <strong>Red Flag <\/strong>tenders displayingrisk of potential irregularities. The algorithm assesses only the variables of Competition and Competitiveness. Models: Instruments and Principles of <strong>Open Contracting Partnership<\/strong>; Risk Assessment Tools from <strong>Transparency International.<\/strong><\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p><strong>What have we found<\/strong><\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p><strong>Disclosed Data<\/strong> and <strong>RedFlag<\/strong> Assessment prompt media investigations; public debates; audits of the Supreme State Control, in some cases even Criminal Complaints in SPAK are based on Open Procurement Albania evidence.<\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>15 to 35% of Tender procedures are RedFlaged, marked for displaying concerning competition and potential clientelism. Municipality tenders score 15% Redfleg procedures, while the Health Sector 30%.<\/p>\r\n\r\n\r\n\r\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" class=\"wp-image-20124\" src=\"https:\/\/ndiqparate.al\/wp-content\/uploads\/2023\/10\/Screenshot-2023-10-18-143008-1.png\" alt=\"\" \/><\/figure>\r\n\r\n\r\n\r\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" class=\"wp-image-20125\" src=\"https:\/\/ndiqparate.al\/wp-content\/uploads\/2023\/10\/Screenshot-2023-10-18-192450-1.png\" alt=\"\" \/><\/figure>\r\n\r\n\r\n\r\n<p>Concentration of Tenders in the hands of Select few Competitors. Absence of foreign companies: <strong>42% of the value tendered in the frame of the State Reconstruction Program was awarded to only 15 local companies.<\/strong><\/p>\r\n<p>\r\n\r\n<\/p>\r\n<p>Businesses Companies allegedly involved in money laundering of organized crime, were given the status of Public Contractor in tenders.
