Ligji 97.2019, pjesa Prokurimet Programi Rind\u00ebrtimit, c\u00ebnon Liri Ekonomike, ka potencial p\u00ebr pabarazi, klienteliz\u00ebm dhe korrupsion."},"content":{"rendered":"<p>Organizata AIS e njohur si Open Data Albania ka depozituar n\u00eb Gjykat\u00ebn Kushtetuese nj\u00eb\u00a0<strong><a style=\"color: #0000ff;\" href=\"http:\/\/ndiqparate.al\/wp-content\/uploads\/2021\/09\/AIS-Gjykaten-Kushtetuese.pdf\">K\u00ebrkes\u00eb<\/a>\u00a0p\u00ebr Shfuqizim t\u00eb pjessh\u00ebm<\/strong>\u00a0t\u00eb Aktit Normativ me fuqin\u00eb e Ligjit Akt nr. 9, dat\u00eb 16.12.2019 titull \u201cP\u00ebr p\u00ebrballimin e pasojave t\u00eb fatkeq\u00ebsis\u00eb natyrore\u201d, miratuar nga Kuvendi i Shqip\u00ebris\u00eb me ligjin nr. 97\/2019, n\u00eb dat\u00ebn 18.12.2019, konkretisht shfuqizim t\u00eb\u00a0<strong>Kreut VI,<\/strong>\u00a0<strong>Procedurat e Prokurimit Publik, nenet 40 \u2013 44, dhe neni 4, pika 7 dhe pika 9.<\/strong><\/p>\n<p>Ky Akt Normativ me fuqin\u00eb e Ligjit, n\u00eb opinionin dhe arsyetimin e Organizat\u00ebs ton\u00eb, n\u00eb pjes\u00ebn p\u00ebr\u00a0<em>Prokurimet\u00a0<\/em><em>P\u00ebr p\u00ebrballimin e pasojave t\u00eb fatkeq\u00ebsis\u00eb natyrore pas T\u00ebrmetit t\u00eb 26 N\u00ebntorit 2019<\/em>, cenon nj\u00eb t\u00eb drejt\u00eb kushtetuese q\u00eb \u00ebsht\u00eb ajo\u00a0<strong>e\u00a0<\/strong><strong>liris\u00eb s\u00eb veprimtaris\u00eb ekonomike, parashikuar n\u00eb nenin 11 t\u00eb Kushtetut\u00ebs.<\/strong><\/p>\n<p>Duke cenuar Lirin\u00eb p\u00ebr Veprimtari Ekonomike krijohen hap\u00ebsira p\u00ebr pabarazi, klienteliz\u00ebm, kontraktim preferencial, favorizim dhe veprime Korrupsioni n\u00eb d\u00ebm t\u00eb Fondeve Publike.<\/p>\n<p>Ky Akt Normativ ka vendosur me Ligj\u00a0<em>Llojin e Procedur\u00ebs<\/em>,\u00a0<em>Afatet p\u00ebr Pjes\u00ebmarrje<\/em>,\u00a0<em>Afatet p\u00ebr Ankimim<\/em>\u00a0dhe\u00a0<em>Vler\u00ebsim<\/em>\u00a0duke anashkaluar Legjislacionin Komb\u00ebtar p\u00ebr Prokurimet Publike dhe duke kufizuar t\u00eb drejt\u00ebn p\u00ebr gar\u00eb dhe barazi.<\/p>\n<p>Pal\u00eb t\u00eb Interesuara n\u00eb k\u00ebt\u00eb\u00a0<strong><a style=\"color: #0000ff;\" href=\"http:\/\/ndiqparate.al\/wp-content\/uploads\/2021\/09\/AIS-Gjykaten-Kushtetuese.pdf\">Padi<\/a><\/strong>\u00a0jan\u00eb Kuvendi dhe K\u00ebshilli i Ministrave.<\/p>\n<p>Disa nga momentet ku Akti nr. 9 me Fuqi Ligji diskriminon lirin\u00eb ekonomike dhe interesin publik p\u00ebr p\u00ebrdorim me eficens\u00eb t\u00eb Paras\u00eb Publike:<\/p>\n<ul>\n<li>Procedur\u00eb ku Nuk Garantohet Gara. Akti Nr. 9 Zgjedh Procedur\u00eb t\u00eb P\u00ebrshpejtuar dhe m\u00eb tej i jep Qeveris\u00eb t\u00eb drejt\u00eb q\u00eb t\u00eb p\u00ebrcaktoj\u00eb me VKM nr. 199, dat\u00eb 04.03.2020 llojin e Procedur\u00ebs Prokurim i Kufizuar (procedure me dy faza) . Kjo nuk garanton gar\u00eb me ofert\u00eb, d\u00ebmton konkurrenc\u00eb e operator\u00ebve, e nxjerr procesin nga sistemi elektronik dhe e zhvendos n\u00eb faz\u00ebn e dyt\u00eb n\u00eb negocim n\u00eb tryez\u00eb ku risku p\u00ebr klienteliz\u00ebm \u00ebsht\u00eb i lart\u00eb. Procedura e P\u00ebrshpejtuar aplikohet p\u00ebr sektor specifik ku numri i operator\u00ebve veprues \u00ebsht\u00eb i ul\u00ebt<strong>.\u00a0<\/strong>N\u00eb rastin konkret po prokurohen kryesisht nd\u00ebrtime (banesa dhe objekte arsimore) dhe natyra e prokurimit n\u00eb raport me gjendjen e tregut shqiptar t\u00eb kompanive q\u00eb operojn\u00eb n\u00eb fush\u00ebn e nd\u00ebrtimit \u00ebsht\u00eb shum\u00eb e favorshme dhe Procedura e P\u00ebrshpejtuar dhe e Kufizuar nuk jan\u00eb t\u00eb nevojshme.<\/li>\n<li>Afatet kufizuese p\u00ebr Paraqitjen e Dokumentacionit nga \u00a0operator\u00ebt ekonomik\u00eb, n\u00eb pjes\u00ebn e Ligjit q\u00eb ne k\u00ebrkojm\u00eb t\u00eb shfuqizojm\u00eb, afati vet\u00ebm 10 ditor ka kufizuar n\u00eb m\u00ebnyr\u00eb drastike konkurrenc\u00ebn, pasi \u00ebsht\u00eb pothuajse e pamundur t\u00eb p\u00ebrgatit\u00ebsh nj\u00eb set t\u00eb madh dokumentesh dhe preventivave teknik p\u00ebr nj\u00eb periudh\u00eb 10 ditore.<\/li>\n<li>Diskriminohen Bizneset e Huaja. Gjithashtu afati 10 ditor i p\u00ebrjashton \u201cde facto\u201d ofertat e operator\u00ebve t\u00eb huaj. Vlen t\u00eb p\u00ebrmendim k\u00ebtu se nj\u00eb operator i Huaj ka detyrimin q\u00eb dokumentacion zyrtar ta paraqes\u00eb me vul\u00eb apostille.<\/li>\n<li>Afati jo serioz vet\u00ebm 2 dit\u00eb p\u00ebr Ankimin ndaj kritereve t\u00eb procedur\u00ebs s\u00eb prokurimit, i p\u00ebrcaktuar n\u00eb Aktin Normativ nr. 9 \u00ebsht\u00eb jasht\u00ebzakonisht kufizues p\u00ebr operator\u00ebt ekonomik\u00eb t\u00eb cil\u00ebt mund t\u00eb ngrej\u00eb pretendime p\u00ebr kritere kualifikimi jo ligjore. Sqarojm\u00eb faktin se jan\u00eb pik\u00ebrisht kriteret e kualifikimit ato t\u00eb cilat krijojn\u00eb premisa \/ incentiva apo e pamund\u00ebsojn\u00eb pjes\u00ebmarrjen n\u00eb nj\u00eb procedur\u00eb prokurimi.<\/li>\n<li>Afati jo objektiv vet\u00ebm 3-ditor i trajtimit t\u00eb ankes\u00ebs nga ana e Komisionit t\u00eb prokurimit Publik \u00ebsht\u00eb t\u00ebr\u00ebsisht jo \u2013 objektiv. N\u00eb ligjin nr. 9643 afati i trajtimit t\u00eb ankes\u00ebs \u00ebsht\u00eb 15 dit\u00eb nd\u00ebrsa Ligji nr. 162\/2020 \u00ebsht\u00eb 30 dit\u00eb.<\/li>\n<li>Akti me Fuqi Ligji ka shkurtuar afatet e vler\u00ebsimit t\u00eb ofertave me 5 dit\u00eb dhe duke marr\u00eb n\u00eb konsiderat\u00eb faktin se kryesisht procedurat e prokurimit q\u00eb zhvillohen n\u00eb baz\u00eb t\u00eb aktit normativ nr. 9 jan\u00eb procedura mbi kufirin e lart\u00eb monetar, dhe kan\u00eb volum dokumentacioni at\u00ebher\u00eb afati 10 ditor i vler\u00ebsimit t\u00eb ofertave e v\u00eb n\u00eb v\u00ebshtir\u00ebsi serioze cil\u00ebsin\u00eb e vler\u00ebsimit dhe mund\u00ebsin\u00eb e verifikimit objektiv t\u00eb t\u00eb gjith\u00eb dokumentacionit t\u00eb paraqitur nga ofertuesit.<\/li>\n<li>Vlera e sigurimit t\u00eb kontrat\u00ebs e parashikuar n\u00eb mas\u00ebn<strong>\u00a05% m\u00eb e lart\u00eb<\/strong>\u00a0n\u00eb Aktin Normativ krahasuar me Ligjin nr. 9643 dhe ligjin nr. 162\/2020, v\u00ebrehet nj\u00eb hap regresi dhe diskriminim t\u00eb operator\u00ebve ekonomik\u00eb q\u00eb konkurrojn\u00eb dhe n\u00ebnshkruajn\u00eb procedura t\u00eb p\u00ebrshpejtuara, n\u00eb raport me operator\u00ebt ekonomik\u00eb q\u00eb konkurrojn\u00eb apo p\u00ebrzgjidhen fitues n\u00eb procedura normale prokurimi.<\/li>\n<\/ul>\n<p>AIS paraqet k\u00ebrkes\u00ebn p\u00ebr\u00a0<strong>pezullimin<\/strong>\u00a0dhe\u00a0<strong>shfuqizim<\/strong>\u00a0t\u00eb Aktit Normativ me Fuqi Ligji, pjesa p\u00ebr Prokurimet p\u00ebr shkak se sjell pasoja q\u00eb prekin interesa shtet\u00ebrore, shoq\u00ebrore ose t\u00eb individ\u00ebve.<\/p>\n<p>Autoritet kontraktore n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb nuk kan\u00eb asnj\u00eb pasoj\u00eb nga kjo pezullimi dhe shfuqizimi q\u00eb ne k\u00ebrkojm\u00eb para Kushtetueses (Pezullimi dhe Shfuqizimi),\u00a0<strong>pasi<\/strong>\u00a0Fondi i Rind\u00ebrtimit, mund t\u00eb tenderohet p\u00ebrmes Ligjit nr. 162\/2020 \u201cP\u00ebr prokurimin publik\u201d, hyr\u00eb n\u00eb fuqi n\u00eb 31 mars 2021, si ligj organik q\u00eb rregullon n\u00eb m\u00ebnyr\u00eb t\u00ebr\u00ebsore fush\u00ebn e prokurimeve publike, i hartuar sipas direktivave t\u00eb legjisacionit t\u00eb BE-s\u00eb n\u00eb fush\u00ebn e prokurimit, i cili i jep zgjidhje cdo situate, qoft\u00eb emergjente, qoft\u00eb normale, n\u00eb t\u00eb cil\u00ebn gjenden autoritet kontraktore.<\/p>\n<p>Organizata ka monitoruar t\u00eb Gjitha Kontraktimet q\u00eb Lidhen ne Programin e Rind\u00ebrtimit pas T\u00ebrmetit t\u00eb 26 N\u00ebntorit 2019.
