Organizata njihet si promotore e t\u00eb dh\u00ebnave t\u00eb hapura dhe transparente (Open Data Albania). Ve\u00e7 publikimit n\u00eb format <em>Open Data<\/em> t\u00eb deklarimeve mbi shpenzime dhe t\u00eb ardhura t\u00eb subjekteve zgjedhore, AIS p\u00ebrmes programeve t\u00eb saj <em>Money Government and Politics<\/em> dhe <em>Za\u2019Lart<\/em> ka zbardhur, analizuar dhe sensibilizuar n\u00eb m\u00ebnyr\u00eb t\u00eb vazhdueshme mbi detaje dhe problematika t\u00eb Financimeve Zgjedhore n\u00eb fushatat e fundit. N\u00eb pro\u00e7eset zgjedhore 2013 dhe 2015, AIS \u00ebsht\u00eb angazhuar edhe n\u00eb iniciativ\u00ebn p\u00ebr Dhom\u00ebn Zgjedhore, iniciativ\u00eb e disa organizatave p\u00ebr t\u00eb monitoruar dhe kontribuar p\u00ebr zgjedhje t\u00eb rregullta dhe t\u00eb drejta. Aktualisht AIS \u00ebsht\u00eb pal\u00eb k\u00ebrkuese n\u00eb nj\u00eb Proces Gjyq\u00ebsor kundrejt tre partive m\u00eb t\u00eb m\u00ebdha politike. Gjykat\u00ebs i \u00ebsht\u00eb k\u00ebrkuar t\u00eb shprehet n\u00ebse Partit\u00eb Politike si subjekte elektorale, kan\u00eb detyrim t\u2019i p\u00ebrgjigjen k\u00ebrkesave p\u00ebr informim mbi burime t\u00eb financimit zgjedhor, n\u00eb \u00e7do koh\u00eb, e konkretisht n\u00eb koh\u00eb reale gjat\u00eb fushat\u00ebs zgjedhore. Procesi aktualisht \u00ebsht\u00eb n\u00eb Gjykat\u00ebn e Lart\u00eb.<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Propozimet dhe Diskutimet q\u00eb do t\u00eb parashtrohen kan\u00eb t\u00eb b\u00ebjn\u00eb vet\u00ebm me pjes\u00ebn e Financimit t\u00eb Fushat\u00ebs, konkretisht nene 86 deri 92 t\u00eb Kodit Zgjedhor.<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">N\u00eb nj\u00eb p\u00ebrmbledhje ajo \u00e7\u2019ka ne propozojm\u00eb e renditur n\u00eb pika t\u00eb p\u00ebrgjithshme \u00ebsht\u00eb si vijon:<\/p>\n<ol>\n<li><em><em><br \/>\n<\/em><\/em><\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Dhurime vet\u00ebm p\u00ebrmes llogarive bankare.<\/p>\n<p>T\u00eb vendosej detyrimi ligjor p\u00ebr deklarim dhe dhurim me sistem bankar (jo kesh) p\u00ebr \u00e7do vler\u00eb dhurimi fond jo publik, e jo vet\u00ebm p\u00ebr vlera t\u00eb dhurimeve mbi 100 mij\u00eb lek\u00eb. Ndryshim n\u00eb Nenin 90 pika 2 e Kodit Zgjedhor. N\u00eb fushata t\u00eb m\u00ebhershme sikurse edhe kjo e fundit, dhurimet n\u00eb kesh arrijn\u00eb deri n\u00eb 50% t\u00eb totalit t\u00eb fondeve jo publike t\u00eb siguruara p\u00ebr fushat\u00ebn.<\/li>\n<li><em><em><br \/>\n<\/em><\/em><\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Informim n\u00eb koh\u00eb reale mbi donacione t\u00eb fushat\u00ebs (donacion n\u00eb instrument monetar).<\/p>\n<p>N\u00eb fakt ky lloj rregullimi ka baz\u00eb n\u00eb Kushtetut\u00eb neni 9 paragrafi i tret\u00eb; ku shprehimisht thuhet <em>Burimet financiare t\u00eb partive, si dhe shpenzimet e tyre b\u00ebhen kurdoher\u00eb publike<\/em>. Ky rregullim ka qen\u00eb m\u00eb her\u00ebt edhe n\u00eb Kod por \u00ebsht\u00eb hequr me ndryshimet e b\u00ebra p\u00ebr nenin 90 paragrafi 1 kur dikur thuhej: <em>Lista e personave q\u00eb dhurojn\u00eb shuma jo m\u00eb pak se 100 mij\u00eb lek\u00eb, si dhe vlera p\u00ebrkat\u00ebse duhet t\u00eb b\u00ebhen kurdoher\u00eb publike.<\/em> Por me ndryshimet e b\u00ebra me Ligjin nr 74.2012 dat\u00eb 19. 07. 2012 kjo fjali \u00ebsht\u00eb hequr duke krijuar regres n\u00eb t\u00eb drejt\u00ebn p\u00ebr informacion publik mbi mb\u00ebshtet\u00ebsit e nj\u00eb partie politike p\u00ebrmes donacioneve, edhe p\u00ebrpara dat\u00ebs s\u00eb votimit.<\/li>\n<li><em><em><br \/>\n<\/em><\/em><\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">T\u00eb shmanget me parashikim t\u00eb qart\u00eb ligjor, \u00e7do marr\u00ebdh\u00ebnie donacioni, subvencioni apo kreditim nd\u00ebrmjet subjekteve elektorale dhe subjekteve mediatike.<\/p>\n<p>Neni q\u00eb parashikon konfliktin e interesit,\u00a0 neni 89 e p\u00ebrjashton subjektin q\u00eb ushtron veprimtari mediatike apo \u00ebsht\u00eb aksioner n\u00eb nj\u00eb subjekt t\u00eb till\u00eb, nga e drejta p\u00ebr t\u00eb qen\u00eb donator i nj\u00eb subjekti elektoral.\u00a0 Dhe kjo \u00ebsht\u00eb mjaft korrekte n\u00eb respekt t\u00eb parimit t\u00eb pavar\u00ebsis\u00eb s\u00eb medias, dhe ndarjes s\u00eb k\u00ebtyre dy pushteteve. Nga ana tjet\u00ebr Neni 84, paragrafi 6 i Kodit Zgjedhor krijon nj\u00eb burim financiar shtes\u00eb p\u00ebr partit\u00eb e r\u00ebnd\u00ebsishme politike. Media detyrohet me ligj t\u00eb dhuroj\u00eb nj\u00eb pjes\u00eb t\u00eb minutave p\u00ebr partit\u00eb q\u00eb kan\u00eb konsumuar nj\u00eb koh\u00eb t\u00eb caktuar reklame kundrejt pages\u00ebs. Ky nen duhet shfuqizuar pasi: 1 krijon nj\u00eb marr\u00ebdh\u00ebnie dhurimi kontradiktore me rregullimin e nenit 98; 2. krijon v\u00ebshtir\u00ebsi n\u00eb monitorim; 3. \u00ebsht\u00eb p\u00ebrdorur n\u00eb m\u00ebnyr\u00eb arbitrare edhe n\u00eb zgjedhje p\u00ebr pushtetin vendor nd\u00ebrsa ligji e parashikon vet\u00ebm p\u00ebr zgjedhje t\u00eb p\u00ebrgjithshme; 4. nuk jemi n\u00eb situata ku partit\u00eb kan\u00eb mungesa dhe v\u00ebshtir\u00ebsi n\u00eb mbulim t\u00eb kostove financiare t\u00eb reklam\u00ebs. Reklama politike \u00ebsht\u00eb b\u00ebr\u00eb tep\u00ebr masive n\u00eb emetime mediatike t\u00eb fushat\u00ebs, dhe do ishte mir\u00eb q\u00eb t\u00eb orientohet \u00e7do subjekt politik drejt cil\u00ebsis\u00eb s\u00eb mesazhit dhe reklam\u00ebs, dhe jo drejt sasis\u00eb.<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Gjithashtu jemi n\u00eb kontekste t\u00eb tjera ku media edhe audovizive, nuk q\u00ebndron ngusht\u00ebsisht n\u00eb cil\u00ebsin\u00eb e mediave t\u00eb licencuara si media komb\u00ebtare. Ka formate t\u00eb ndryshme t\u00eb emetimit audioviziv bazuar n\u00eb teknologjin\u00eb e re.<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Po kaq i gabuar dhe kontradiktor do t\u00eb konsiderohet edhe rregullimi p\u00ebr reklam\u00ebn pa pages\u00eb i b\u00ebr\u00eb n\u00eb ndryshimin e Ligjit p\u00ebr Partit\u00eb n\u00eb Maj 2017. Ligj q\u00eb bie ndesh me Kodin aktual.<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Kodi i ri elektoral, do t\u00eb duhet t\u00eb respektoj\u00eb n\u00eb m\u00ebnyr\u00eb shteruese ndales\u00ebn p\u00ebr pozicionin e donatorit p\u00ebr subjektet mediatike. Subjektet mediatike duhet t\u00eb jen\u00eb pal\u00eb t\u00eb partive dhe subjekteve elektorale vet\u00ebm p\u00ebrmes kontratave tregtare t\u00eb cilat do ishte mir\u00eb t\u00eb ishin gjithashtu t\u00eb aksesueshme nga publiku p\u00ebr rastin e kontraktimeve n\u00eb fushat\u00eb zgjedhore. Po k\u00ebshtu duhet par\u00eb me kujdes edhe situata e faturave t\u00eb papaguara dhe situatave debitore. Subjektet tregtare e kan\u00eb t\u00eb drejt\u00ebn e tyre t\u00eb k\u00ebrkimit t\u00eb detyrimeve. Por kur subjekti debitor \u00ebsht\u00eb nj\u00eb parti politike me pushtet, k\u00ebrkimi i debive \u00ebsht\u00eb nj\u00eb \u00e7\u00ebshtje e\u00a0 mundshme intimidimi dhe influence. P\u00ebr t\u00eb mos lejuar situata t\u00eb tilla ku borxhi kthehet n\u00eb donacion, ligji zgjedhor duhet t\u00eb parashikoj\u00eb edhe nd\u00ebrhyrje t\u00eb KQZ gjat\u00eb shp\u00ebrndarjes s\u00eb fondit vjetor apo zgjedhor p\u00ebr partit\u00eb, duke i dh\u00ebn\u00eb prioritet\u00a0 n\u00eb likuidim t\u00eb detyrimeve t\u00eb deklaruara si t\u00eb njohura e t\u00eb papaguara gjat\u00eb fushat\u00ebs. I nj\u00ebjti prioritet likuidimi me fondet publike duhet t\u00eb jet\u00eb edhe p\u00ebr debitor\u00eb t\u00eb palikujduar t\u00eb fushatave q\u00eb nuk jan\u00eb subjekt mediatik.<\/p>\n<\/li>\n<li><em><em><br \/>\n<\/em><\/em><\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Rregullim m\u00eb efikas i rasteve t\u00eb parashikuara si konflikt interesi p\u00ebr donator\u00ebt.<\/p>\n<p>T\u00eb vendosen parashikime ligjore m\u00eb t\u00eb zgjeruara p\u00ebr parandalimin; deklarimin dhe kontrollin e konfliktit t\u00eb interesit p\u00ebr Donator\u00ebt. Kodi Zgjedhor p\u00ebrmes nenit 89 parashikon disa situata t\u00eb ndaluara. Ky nen k\u00ebrkon rregullim dhe zgjerim t\u00eb parashikimeve. K\u00ebshtu fjala aksionar do ishte mir\u00eb t\u00eb z\u00ebvend\u00ebsohej me fjal\u00ebn zot\u00ebrues. P\u00ebrve\u00e7 parashikimit p\u00ebr kontrata dhe fonde publike t\u00eb parashikohej si konflikt interesi edhe rasti i p\u00ebrfitimeve nga programe t\u00eb subvencionit publik; kreditimit t\u00eb garantuar me fonde publike; p\u00ebrfitues n\u00eb privatizime t\u00eb aseteve publike; p\u00ebrfitues nga legalizime; p\u00ebrfitues nga programe publike n\u00eb dobi t\u00eb biznesit. Etj.<\/li>\n<li><em><em><br \/>\n<\/em><\/em><\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Parashikim ligjor i verifikimit administrativ p\u00ebr rastet n\u00eb konflikt interesi.<\/p>\n<p>Do t\u00eb ishte me vend q\u00eb KQZ t\u00eb kishte kompetenc\u00eb p\u00ebr verifikim dhe hetim administrativ. Kjo p\u00ebrmes k\u00ebrkes\u00ebs p\u00ebr informacion pran\u00eb institucioneve publike n\u00eb lidhje me respektimin e parashikimeve dhe ndalimeve si konflikt interesi. Verifikim pran\u00eb tatimeve mbi debitor\u00ebt; pran\u00eb Agjencis\u00eb s\u00eb Prokurimeve Publike mbi kontrata publike; pran\u00eb Regjistrit Koncesionar p\u00ebr kontratat koncensionare dhe k\u00ebshtu me radh\u00eb. Gjithashtu edhe sanksioni p\u00ebr donator\u00ebt n\u00eb rast t\u00eb deklarimit t\u00eb rrem\u00eb t\u00eb mospasjes konflikt interesi \u00ebsht\u00eb nj\u00eb sanksion q\u00eb duhet t\u00eb parashikohet n\u00eb Kod.<\/li>\n<li><em><em><br \/>\n<\/em><\/em><\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Afate m\u00eb reale t\u00eb periudh\u00ebs n\u00ebn raportim t\u00eb fushat\u00ebs zgjedhore.<\/p>\n<p>N\u00eb kontekstin aktual Kodi njeh si periudh\u00eb p\u00ebr raportim dhe auditim zgjedhor periudh\u00ebn 30 ditore. Ndryshimet n\u00eb Ligj krijuan premisa por jo detyrim ligjor p\u00ebr nj\u00eb periudh\u00eb m\u00eb t\u00eb gjat\u00eb. Mir\u00eb \u00ebsht\u00eb q\u00eb ky afat t\u00eb rregullohet me ligjin zgjedhor Kodi. Dhe afati i raportimit financiar p\u00ebr shpenzime zgjedhore t\u00eb jet\u00eb m\u00eb shum\u00eb se 30 dit\u00eb p\u00ebrpara fillimit.<\/li>\n<li><em><em><br \/>\n<\/em><\/em><\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Kufizimi i totalit t\u00eb shpenzimeve zgjedhore \u00ebsht\u00eb i pabazuar, sjell premisa p\u00ebr mosdeklarim.<\/p>\n<p>Nuk kemi pse t\u00eb kemi kufizime t\u00eb tilla. Le t\u2019u japim mund\u00ebsi Partive dhe Subjekteve t\u00eb legalizojn\u00eb dhe t\u00eb tregohen transparent n\u00eb raportimin e mb\u00ebshtetjes dhe mund\u00ebsive t\u00eb tyre p\u00ebr t\u00eb siguruar instrumente financiare t\u00eb ligjshme p\u00ebr fushat\u00ebn. Mbledhja e fondeve p\u00ebr subjektet elektorale n\u00eb fushat\u00eb nuk duhet par\u00eb vet\u00ebm si mund\u00ebsi por edhe si nj\u00eb shprehje e besimit t\u00eb votuesve edhe p\u00ebrmes donacioneve. Propozohet k\u00ebshtu shfuqizimi i nenit <u><u>90 paragrafi 3.<\/u><\/u>&nbsp;<\/li>\n<li><em><em><br \/>\n<\/em><\/em><\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Ruajtja e financimit miks fonde publike dhe jopublike p\u00ebr subjektet elektorale.<\/p>\n<p>AIS nuk mb\u00ebshtet propozime p\u00ebr t\u00eb kaluar n\u00eb financim me nj\u00eb lloj burimi financiar p\u00ebr fushat\u00ebn. Jemi kund\u00ebr propozimeve p\u00ebr t\u00eb mbuluar plot\u00ebsisht me para publike fushatat, kjo pasi i b\u00ebn partit\u00eb t\u00eb identifikohen me subjekte buxhetore shtet\u00ebrore.<\/li>\n<li><em><em><br \/>\n<\/em><\/em><\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Rregullim m\u00eb i qart\u00eb i burimit t\u00eb financimit p\u00ebrmes kredive dhe deklarimit t\u00eb t\u00eb dh\u00ebnave t\u00eb kreditimit n\u00ebp\u00ebrmjet nj\u00eb regjistri t\u00eb posa\u00e7\u00ebm.<\/p>\n<p>Neni 87 \/ 1 pika \u00e7 Kredit\u00eb. Do t\u00eb duhet t\u00eb parashikohet edhe deklarimi i t\u00eb dh\u00ebnave t\u00eb kreditimit duke paracaktuar dhe listuar kategorit\u00eb e t\u00eb dh\u00ebnave p\u00ebr deklarim. Garant\u00ebt e kreditimit, kushtet, afatet, barra siguruese, forma e aplikimit, t\u00eb dh\u00ebna t\u00eb identitetit t\u00eb subjektit kreditues. Duhet parashikuar a mund t\u00eb merren kredi n\u00eb institucione jo t\u00eb licencuara p\u00ebr veprimtari financiare; duhet sakt\u00ebsuar a lejohet kreditimi apo garantimi i tij nga subjekte t\u00eb huaja.<\/li>\n<li><em><em><br \/>\n<\/em><\/em><\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">T\u00eb konsiderohet mund\u00ebsia p\u00ebr raportim financiar edhe sipas deg\u00ebve t\u00eb partive politike n\u00eb rastin e zgjedhjeve t\u00eb p\u00ebrgjithshme dhe sipas shtabeve t\u00eb kandidat\u00ebve p\u00ebr kryebashkiak, n\u00eb rastin e zgjedhjeve lokale.<\/p>\n<p>Ky parashikim nuk \u00ebsht\u00eb n\u00eb Kod dhe as n\u00eb ligjin P\u00ebr Partit\u00eb Politike. Do t\u00eb ishte me vend q\u00eb t\u00eb k\u00ebrkohej nj\u00eb disiplinim m\u00eb i mir\u00eb i raportimit financiar sipas zonave elektorale.<\/li>\n<li><em><em><br \/>\n<\/em><\/em><\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Ligji Zgjedhor (Kodi) do t\u00eb duhet t\u00eb vler\u00ebsoj\u00eb m\u00eb qart\u00eb n\u00ebse pranon dhurime nga subjekte t\u00eb regjistruara si organizma jofitimprur\u00ebs (jo qeveritare).<\/p>\n<p>Kodi nuk ka ndonj\u00eb ndales\u00eb. Po k\u00ebshtu ligji p\u00ebr OJF ka rregullime jo shteruese.
