Aktet juridike q\u00eb nxirren nga k\u00ebto organe duhet t\u00eb jen\u00eb n\u00eb pajtim me aktet juridike m\u00eb t\u00eb larta si n\u00eb kuptimin formal, ashtu edhe at\u00eb material. Respektimi i hierarkis\u00eb s\u00eb akteve normative \u00ebsht\u00eb nj\u00eb detyrim q\u00eb rrjedh nga parimi i shtetit t\u00eb s\u00eb drejt\u00ebs dhe i koherenc\u00ebs n\u00eb sistemin ligjor (vendimet nr.2, dat\u00eb 03.02.2010; nr.1, dat\u00eb 12.01.2011; nr. 23, dat\u00eb 08.06.2011; nr. 25, dat\u00eb 28.04.2014 t\u00eb Gjykat\u00ebs Kushtetuese).<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Neni 4\/1 i Kushtetut\u00ebs parashikon: \u201cE drejta p\u00ebrb\u00ebn baz\u00ebn dhe kufijt\u00eb e veprimtaris\u00eb s\u00eb shtetit&#8221;. M\u00eb tej, neni 116 i Kushtetut\u00ebs p\u00ebrcakton hierarkin\u00eb e burimeve t\u00eb s\u00eb drejt\u00ebs, si nj\u00eb prej vlerave themelore t\u00eb shtetit t\u00eb s\u00eb drejt\u00ebs, ku pushteti ligjv\u00ebn\u00ebs ka rol primar. P\u00ebrcaktimi n\u00eb Kushtetut\u00eb i hierarkis\u00eb s\u00eb akteve, si dhe sanksionimi i parimit t\u00eb ndarjes dhe balancimit t\u00eb pushteteve n\u00eb ushtrimin e funksioneve t\u00eb organeve kushtetuese, t\u00eb cilat ushtrohen n\u00ebp\u00ebrmjet nxjerrjes s\u00eb akteve normative, \u00ebsht\u00eb mish\u00ebrimi m\u00eb i plot\u00eb i parimit t\u00eb shtetit t\u00eb s\u00eb drejt\u00ebs n\u00eb nj\u00eb sistem parlamentar. Parlamenti, me pushtetin e veshur nga sovrani p\u00ebr krijimin e burimeve primare t\u00eb s\u00eb drejt\u00ebs, autorizon nxjerrjen e akteve normative p\u00ebr materializimin konkret t\u00eb vullnetit t\u00eb tij. Ky autorizim duhet t\u2019u p\u00ebrmbahet kritereve t\u00eb p\u00ebrcaktuara n\u00eb nenin 118 t\u00eb Kushtetut\u00ebs p\u00ebr t\u00eb qen\u00eb n\u00eb harmoni me parimin e ndarjes dhe balancimit t\u00eb pushteteve, si dhe me hierarkin\u00eb e akteve normative t\u00eb sanksionuara p\u00ebrkat\u00ebsisht n\u00eb nenin 7 dhe nenin 116 t\u00eb Kushtetut\u00ebs (vendimi nr.5, dat\u00eb 5.2.2014 t\u00eb Gjykat\u00ebs Kushtetuese).<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Neni 118\/1 i Kushtetut\u00ebs sanksionon se \u201caktet n\u00ebnligjore nxirren n\u00eb baz\u00eb dhe p\u00ebr zbatim t\u00eb ligjeve nga organet e parashikuara n\u00eb Kushtetut\u00eb\u201d. Nd\u00ebrsa paragrafi i dyt\u00eb i k\u00ebtij neni parashikon: \u201cligji duhet t\u00eb autorizoj\u00eb nxjerrjen e akteve n\u00ebnligjore, t\u00eb p\u00ebrcaktoj\u00eb organin kompetent, \u00e7\u00ebshtjen q\u00eb duhet rregulluar, si dhe parimet n\u00eb baz\u00eb t\u00eb t\u00eb cilave nxirren k\u00ebto akte.\u201d<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">K\u00ebto dispozita ndihmojn\u00eb p\u00ebr t\u2019i dh\u00ebn\u00eb kuptimin kushtetues dhe doktrinar konceptit \u201crezerv\u00eb ligjore\u201d, n\u00ebp\u00ebrmjet t\u00eb cilit kufizohet apo orientohet pushteti normativ i organeve ekzekutive p\u00ebr t\u00eb rregulluar marr\u00ebdh\u00ebnie t\u00eb caktuara me akte n\u00ebnligjore. Kjo rezerv\u00eb ligjore krijon mund\u00ebsin\u00eb q\u00eb \u00e7\u00ebshtja konkrete e rregulluar pjes\u00ebrisht me ligj t\u00eb mund t\u00eb detajohet m\u00eb tej nga aktet n\u00ebnligjore, duke iu p\u00ebrmbajtur parimeve dhe kufijve t\u00eb p\u00ebrcaktuar nga ligji. Vet\u00ebm n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb autorizimi i ligjv\u00ebn\u00ebsit p\u00ebr nxjerrjen e akteve n\u00ebnligjore mund t\u00eb konsiderohet i realizuar brenda kufijve t\u00eb kushtetutshm\u00ebris\u00eb.<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Sipas nenit 17 t\u00eb Kushtetut\u00ebs, t\u00eb drejtat dhe lirit\u00eb e individit mund t\u00eb kufizohen vet\u00ebm me ligj. Duke iu referuar p\u00ebrmbajtjes s\u00eb nenit 17 t\u00eb Kushtetut\u00ebs, Gjykata Kushtetuese \u00e7mon se kjo dispozit\u00eb, n\u00eb m\u00ebnyr\u00ebn se si \u00ebsht\u00eb formuluar, nuk i ka l\u00ebn\u00eb mund\u00ebsi delegimi ndonj\u00eb organi tjet\u00ebr p\u00ebrve\u00e7 Kuvendit si organ p\u00ebrfaq\u00ebsues. Q\u00ebllimi i k\u00ebtij neni \u00ebsht\u00eb q\u00eb n\u00eb rastin e kufizimeve, jo vet\u00ebm duhet t\u00eb respektohen kriteret e tjera t\u00eb caktuara n\u00eb t\u00eb, por n\u00eb m\u00ebnyr\u00eb q\u00eb garancit\u00eb t\u00eb jen\u00eb sa m\u00eb t\u00eb plota, kompetent duhet t\u00eb jet\u00eb vet\u00ebm nj\u00eb organ dhe pik\u00ebrisht, organi m\u00eb i lart\u00eb ligjv\u00ebn\u00ebs. Shprehja \u201cvet\u00ebm me ligj\u201d ka kuptimin q\u00eb n\u00eb rast se \u00ebsht\u00eb i nevojsh\u00ebm kufizimi i nj\u00eb t\u00eb drejte t\u00eb parashikuar n\u00eb Kushtetut\u00eb, at\u00ebher\u00eb ky vler\u00ebsim \u00ebsht\u00eb n\u00eb diskrecion vet\u00ebm t\u00eb ligjv\u00ebn\u00ebsit dhe jo t\u00eb organeve t\u00eb tjera, p\u00ebrfshir\u00eb edhe K\u00ebshillin e Ministrave.<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Gjykata Kushtetuese ka \u00e7muar se rregullimi i parashikuar n\u00eb nenin 17 p\u00ebr kufizimin e t\u00eb drejtave dhe lirive vet\u00ebm me ligj, ka t\u00eb b\u00ebj\u00eb edhe me p\u00ebrcaktimin e kompetenc\u00ebs s\u00eb nj\u00eb organi konkret q\u00eb n\u00eb k\u00ebt\u00eb rast \u00ebsht\u00eb vet\u00ebm Kuvendi. Nj\u00eb shprehje e till\u00eb t\u00eb referon n\u00eb kompetenc\u00ebn e organit ligjv\u00ebn\u00ebs dhe nxjerrja e akteve t\u00eb tjera p\u00ebr t\u00eb rregulluar marr\u00ebdh\u00ebnie t\u00eb tilla, cenon kompetencat e k\u00ebtij organi. \u00c7do interpretim i kund\u00ebrt, \u00ebsht\u00eb padyshim nj\u00eb zhvleft\u00ebsim i garancis\u00eb q\u00eb jep Kushtetuta p\u00ebr mbrojtjen e t\u00eb drejtave dhe lirive t\u00eb njeriut dhe do t\u2019i cenonte efektivisht k\u00ebto liri e t\u00eb drejta. N\u00eb k\u00ebt\u00eb p\u00ebrfundim arrihet edhe duke iu referuar fjal\u00ebs \u201cvet\u00ebm\u201d q\u00eb p\u00ebrmendin nenet 11\/3 e 17 t\u00eb Kushtetut\u00ebs. P\u00ebrdorimi i k\u00ebsaj fjale nuk \u00ebsht\u00eb i rastit, por ai \u00ebsht\u00eb b\u00ebr\u00eb p\u00ebr t\u00eb treguar se kufizime t\u00eb tilla nuk mund t\u00eb vendosen me ndonj\u00eb akt tjet\u00ebr p\u00ebrve\u00e7 ligjit.<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Duke p\u00ebrcaktuar nj\u00eb num\u00ebr domeinesh t\u00eb caktuar 5-10 domaine p\u00ebr subjekt k\u00ebrkues, AKEP ka b\u00ebr\u00eb kufizim t\u00eb t\u00eb drejtave ve\u00e7an\u00ebrisht duke e ballafaquar k\u00ebt\u00eb fakt me mund\u00ebsin\u00eb e sotme t\u00eb pakufizuar p\u00ebr ta.<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Kufizimi i t\u00eb drejtave p\u00ebr nj\u00eb natyr\u00eb t\u00eb till\u00eb duhet b\u00ebhet vet\u00ebm me ligj, sipas nenit 17 t\u00eb Kushtetut\u00ebs dhe jo n\u00ebp\u00ebrmjet Rregullores s\u00eb AKEP, q\u00eb \u00ebsht\u00eb akt n\u00ebnligjor. N\u00ebse do t\u00eb ndodhe nj\u00eb gj\u00eb e till\u00eb AKEP ka marr\u00eb kompetenc\u00ebn ekskluzive t\u00eb Kuvendit p\u00ebr t\u00eb rregulluar n\u00eb m\u00ebnyr\u00eb normative nj\u00eb kufizim t\u00eb till\u00eb. P\u00ebr pasoj\u00eb, cdo akt q\u00eb do t\u00eb prodhoj\u00eb AKEP n\u00eb k\u00ebt\u00eb drejtim \u00ebsht\u00eb n\u00eb pavlefshm\u00ebri absolute dhe p\u00ebr m\u00eb tep\u00ebr ngrihet n\u00eb nivelin e kund\u00ebrshtimit t\u00eb nj\u00eb norme kushtetuese.<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Shembull: organizata jon\u00eb ka m\u00eb shum\u00eb se dhjet\u00eb domain (sub domain) n\u00eb prapashtes\u00ebn.al. Kufizimi i t\u00eb drejt\u00ebs p\u00ebr posedim (jo m\u00eb shum\u00eb se 10) kufizon mund\u00ebsin\u00eb ton\u00eb p\u00ebr t\u00eb p\u00ebrdorur instrumente t\u00eb komunikimit, informimit dhe shprehjes s\u00eb lir\u00eb t\u00eb cilat deri tani i kemi p\u00ebrdorur me ligjshm\u00ebri. Detyrimi p\u00ebr t\u00eb mbyllur ndonj\u00eb nga domainet tona, si pasoj\u00eb e nj\u00eb rregullimi kufizues si ky, do t\u00eb p\u00ebrb\u00ebnte nj\u00eb rast censure dhe cenimi i t\u00eb drejt\u00ebs p\u00ebr t\u00eb ushtruar aktivitet sipas objektivave dhe misionit t\u00eb nj\u00eb shoqat\u00eb jo qeveritare. Po k\u00ebshtu ne kemi n\u00eb proces aplikimi projekte ku kemi parashikuar q\u00eb nj\u00eb fjal\u00ebformim t\u00eb caktuar, duke p\u00ebrdorur prapashtes\u00ebn.al ta sjellim n\u00eb disa gjuh\u00eb zyrtare t\u00eb BE (m\u00eb shum\u00eb se 10). Kjo nuk do t\u00eb ishte e mundur n\u00eb nj\u00eb situat\u00eb ku rregullorja e propozuar do ta b\u00ebnte t\u00eb pamundur p\u00ebrdorimin e nj\u00eb web-i me versione n\u00eb disa gjuh\u00eb dhe me domain apo subdomain t\u00eb p\u00ebrshtatur sipas p\u00ebrmbajtjes<\/p>\n<p>S\u00eb dyti,<\/p>\n<p style=\"color: #222222; font-family: 'Helvetica Neue',Helvetica,Arial,sans-serif; font-weight: normal; text-align: justify; line-height: 20px; font-size: 12px; margin: 0px 0px 20px; padding: 0px;\" align=\"left\">Pasja n\u00eb posedim t\u00eb kaq shum\u00eb domaineve .al, si domaine t\u00eb vet\u00eb Regjistruesve, p\u00ebrb\u00ebn nj\u00eb lloj pengese n\u00eb lirin\u00eb e subjekteve dhe individ\u00ebve p\u00ebr t\u00eb regjistruar nj\u00eb em\u00ebr domaini, n\u00eb ve\u00e7anti t\u00eb atyre q\u00eb zot\u00ebrojn\u00eb marka dhe patenta t\u00eb regjistruara.<br \/>\nKy argument nuk \u00ebsht\u00eb i bazuar n\u00eb nj\u00eb fakt apo k\u00ebrkim shkencor dhe empirik. Fjalori i Gjuh\u00ebs Shqipe i vitit 2006, publikim i Akademis\u00eb s\u00eb Shkencave t\u00eb Shqip\u00ebris\u00eb dhe Institutit t\u00eb Gjuh\u00ebsis\u00eb dhe Let\u00ebrsis\u00eb, sjell 48 000 fjal\u00eb shqipe (pa trajta sipas lakimit dhe zgjedhimit) dhe pa terma teknik apo shkencor.
