P\u00ebr k\u00ebt\u00eb arsye, n\u00eb\nmb\u00ebshtetje t\u00eb nenit 24 t\u00eb Ligjit nr. 119\/2014 &#8220;P\u00ebr t\u00eb drejt\u00ebn (aksesin) e\ninformimit&#8221;, AIS, n\u00eb dat\u00ebn 7 korrik 2015, paraqiti ankes\u00eb p\u00ebrpara\nKomisionerit p\u00ebr t\u00eb Drejt\u00ebn e Informimit dhe Mbrojtjen e t\u00eb Dh\u00ebnave Personale.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">N\u00eb\ndat\u00ebn 25 korrik 2015, Komisioneri p\u00ebr t\u00eb Drejt\u00ebn e Informimit dhe Mbrojtjen e\nt\u00eb Dh\u00ebnave Personale na njoftoi p\u00ebr vendimin e tij nr. 44, dat\u00eb 22.07.2015\n&#8220;P\u00ebr refuzimin e ankes\u00ebs&#8221;. Komisioneri e refuzoi ankimin ton\u00eb nr.\n675, dat\u00eb 9.07.2015, me arsyetimin se &#8220;<em>informacioni\ni k\u00ebrkuar duhet t\u00eb administrohet nga organizatat e parashikuara me k\u00ebt\u00eb ligj\ndhe nenin 2 t\u00eb tij, t\u00eb cilat nuk jan\u00eb p\u00ebrcaktuar si autoritete publike n\u00eb\nkuptimin e m\u00ebnyr\u00ebs sesi ato jan\u00eb t\u00eb organizuara, si ato veprojn\u00eb dhe kuadrit t\u00eb\ntyre rregullator&#8221;.<\/em><\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">N\u00eb\nzbatim t\u00eb Nenit 25 t\u00eb Ligjit nr. 119\/2014 &#8220;P\u00ebr t\u00eb drejt\u00ebn e\ninformimit&#8221;, Instituti Shqiptar i Shkencave paraqiti nj\u00eb k\u00ebrkes\u00eb-padi n\u00eb\nGjykat\u00ebn Administrative t\u00eb Shkall\u00ebs s\u00eb Par\u00eb t\u00eb Tiran\u00ebs.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Pas\np\u00ebrfundimit t\u00eb seancave gjyq\u00ebsore, Gjykata Administrative e Shkall\u00ebs s\u00eb Par\u00eb\nTiran\u00eb u shpreh me vendimin nr. 5687, dat\u00eb 10.11.2015, sipas t\u00eb cilit:\n&#8220;Gjykata rr\u00ebzon k\u00ebrkes\u00eb-padin\u00eb e Institutit Shqiptar t\u00eb Shkencave kund\u00ebr\nKomisionerit p\u00ebr t\u00eb Drejt\u00ebn e Informimit dhe Mbrojtjes s\u00eb t\u00eb Dh\u00ebnave Personale,\nPartis\u00eb Socialiste t\u00eb Shqip\u00ebris\u00eb, Partis\u00eb Demokratike t\u00eb Shqip\u00ebris\u00eb dhe\nL\u00ebvizjes Socialiste p\u00ebr Integrimin e Shqip\u00ebris\u00eb, i cili k\u00ebrkon\n&#8220;Shfuqizimin e vendimit nr. 44, dat\u00eb 22.07.2015 t\u00eb Komisionerit p\u00ebr t\u00eb\nDrejt\u00ebn e Informimit dhe Mbrojtjes s\u00eb t\u00eb Dh\u00ebnave Personale\u201d si padi q\u00eb nuk\nbazohet n\u00eb prova apo n\u00eb ligj.\u201d Gjykat\u00ebs iu t\u00eb vendoste partive politike\n(subjekteve zgjedhore), p\u00ebrkat\u00ebsisht Partis\u00eb Socialiste, Partis\u00eb Demokratike\ndhe L\u00ebvizjes Socialiste p\u00ebr Integrim q\u00eb t&#8217;i japin Institutit Shqiptar t\u00eb\nShkencave informacionin e k\u00ebrkuar p\u00ebr financimin e fushatave t\u00eb tyre zgjedhore\nsipas k\u00ebrkes\u00ebs s\u00eb saj (AIS) t\u00eb dat\u00ebs 9 qershor 2015.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">N\u00eb\ndat\u00ebn 25 n\u00ebntor 2015, Instituti Shqiptar i Shkencave depozitoi n\u00eb Gjykat\u00ebn\nAdministrative t\u00eb Apelit ankim kund\u00ebr vendimit t\u00eb Gjykat\u00ebs Administrative t\u00eb\nShkall\u00ebs s\u00eb Par\u00eb. Gjykata Administrative e Apelit, me vendimin nr. 5236, dat\u00eb\n22.11.2017, vendosi l\u00ebnien n\u00eb fuqi t\u00eb vendimit t\u00eb Gjykat\u00ebs Administrative t\u00eb\nShkall\u00ebs s\u00eb Par\u00eb.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">\u00c7\u00ebshtja\n\u00ebsht\u00eb n\u00eb pritje t\u00eb gjykimit nga Gjykata e Lart\u00eb e Shqip\u00ebris\u00eb.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">N\u00eb\ndat\u00ebn 18 maj 2016, AIS iu drejtua Gjykat\u00ebs Evropiane t\u00eb t\u00eb Drejtave t\u00eb Njeriut,\nduke i k\u00ebrkuar asaj t\u00eb shprehet p\u00ebr proceset gjyq\u00ebsore dhe n\u00ebse ato p\u00ebrb\u00ebjn\u00eb\nshkelje t\u00eb Neneve 6 dhe 13 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Si\u00e7 mund ta jeni n\u00eb dijeni, n\u00eb dat\u00ebn 22 korrik\n2016, Kuvendi i Shqip\u00ebris\u00eb miratoi 17 amendamente kushtetuese t\u00eb nevojshme p\u00ebr\nt\u00eb reformuar sistemin e drejt\u00ebsis\u00eb, duke synuar ndryshimin e imazhit t\u00eb tij,\nduke e b\u00ebr\u00eb at\u00eb m\u00eb t\u00eb pavarur, llogaridh\u00ebn\u00ebs dhe efikas. K\u00ebto ndryshime\nkushtetuese, nd\u00ebr t\u00eb tjera, p\u00ebrfaq\u00ebsojn\u00eb zbatimin e Ligjit t\u00eb Verifikimit, i\nnjohur si rivler\u00ebsimi i p\u00ebrkohsh\u00ebm i gjyqtar\u00ebve dhe prokuror\u00ebve n\u00eb Republik\u00ebn e\nShqip\u00ebris\u00eb.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Procesi i rivler\u00ebsimit t\u00eb an\u00ebtar\u00ebve t\u00eb sistemit\ngjyq\u00ebsor, i njohur ndryshe si procesi i verifikimit <em>(vetting)<\/em>, filloi n\u00eb n\u00ebntor 2017 dhe do t\u00eb p\u00ebrfshij\u00eb mbi 800\ngjyqtar\u00eb dhe prokuror\u00eb, si dhe nj\u00eb num\u00ebr t\u00eb punonj\u00ebsve t\u00eb tjer\u00eb t\u00eb sistemit t\u00eb\ndrejt\u00ebsis\u00eb.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Deri m\u00eb sot, nga rezultatet e procesit t\u00eb\nverifikimit, n\u00eb Gjykat\u00ebn e Lart\u00eb vet\u00ebm 4 gjyqtar\u00eb kan\u00eb kaluar procesionin e\nrivler\u00ebsimit dhe dy prej tyre jan\u00eb ende n\u00eb procedurat e rishikimit n\u00eb Kolegjin\ne Apelimit.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Aktualisht, Gjykata Kushtetuese \u00ebsht\u00eb institucioni\nq\u00eb \u00ebsht\u00eb goditur m\u00eb r\u00ebnd\u00eb nga procesi i rivler\u00ebsimit. Nga n\u00ebnt\u00eb an\u00ebtar\u00eb, vet\u00ebm\ndy prej tyre kan\u00eb kaluar me sukses procesin dhe nj\u00ebri prej tyre \u00ebsht\u00eb n\u00eb\nprocesin e apelimit para Kolegjit t\u00eb Apelimit.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Askush n\u00eb Shqip\u00ebri nuk \u00ebsht\u00eb n\u00eb gjendje t\u00eb\nparashikoj\u00eb kur do t\u00eb krijohen dhe do t\u00eb b\u00ebhen funksionale Gjykata e Lart\u00eb dhe\nGjykata Kushtetuese. Rrjedhimisht, askush n\u00eb Shqip\u00ebri nuk mund t\u00eb jap\u00eb\np\u00ebrgjigje p\u00ebr koh\u00ebn se kur do t\u00eb gjykohet rekursi i AIS-s\u00eb n\u00eb Gjykat\u00ebn e Lart\u00eb\ndhe, n\u00ebse \u00ebsht\u00eb e nevojshme, n\u00eb Gjykat\u00ebn Kushtetuese. Nd\u00ebrkoh\u00eb, \u00e7\u00ebshtja e\nk\u00ebrkes\u00ebs dhe e gjith\u00eb situata humbet aktualitetin, sepse k\u00ebrkesa p\u00ebr\ntransparenc\u00eb t\u00eb financimeve t\u00eb partive politike n\u00eb zgjedhje u paraqit n\u00eb vitin\n2015, dhe ende nuk ka p\u00ebrgjigje p\u00ebrfundimtare nga Kolegji Administrativ i\nGjykat\u00ebs s\u00eb Lart\u00eb\/Gjykat\u00ebs Kushtetuese. Nd\u00ebrkoh\u00eb, zgjedhjet e ardhshme vendore\ndo t\u00eb zhvillohen n\u00eb qershor 2019.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Gjithashtu, duam\nt\u00eb shtojm\u00eb n\u00eb k\u00ebrkes\u00ebn e AIS p\u00ebrpara Gjykat\u00ebs Evropiane t\u00eb t\u00eb Drejtave t\u00eb Njeriut\nargumentet ligjore dhe k\u00ebrkes\u00ebn p\u00ebr shqyrtimin e pretendimit p\u00ebr shkelje t\u00eb\nnenit 10 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut, nga Shqip\u00ebria.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Gjykata\nEvropiane e t\u00eb Drejtave t\u00eb Njeriut n\u00eb rastin <em>Magyar Helsinki Bizottsag kund\u00ebr Hungaris\u00eb<\/em> ka pranuar se nj\u00eb e\ndrejt\u00eb e till\u00eb p\u00ebr informim ose detyrim p\u00ebr t\u00eb dh\u00ebn\u00eb informacion mund t\u00eb lind\u00eb\nn\u00eb dy kategori rastesh: (1) kur dh\u00ebnia e informacionit \u00ebsht\u00eb vendosur me vendim\ngjyq\u00ebsor t\u00eb ekzekutuesh\u00ebm dhe (2) n\u00eb rrethanat ku aksesi n\u00eb informacion \u00ebsht\u00eb i\ndobish\u00ebm p\u00ebr ushtrimin e t\u00eb drejt\u00ebs s\u00eb individit p\u00ebr lirin\u00eb e shprehjes dhe kur\nmohimi i saj p\u00ebrb\u00ebn nj\u00eb nd\u00ebrhyrje n\u00eb at\u00eb t\u00eb drejt\u00eb.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">M\u00eb tej, Gjykata ka p\u00ebrcaktuar kat\u00ebr\nparime, t\u00eb marra nga rastet e fundit t\u00eb jurisprudenc\u00ebs s\u00eb saj n\u00eb lidhje me\naksesin n\u00eb informacion, t\u00eb cilat mund t\u00eb p\u00ebrdoren p\u00ebr t\u00eb p\u00ebrcaktuar n\u00ebse nj\u00eb\nmohim i aksesit p\u00ebrfshihet n\u00eb kategorin\u00eb e dyt\u00eb t\u00eb rasteve.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">&#8211; <strong><em>Q\u00ebllimi i k\u00ebrkes\u00ebs p\u00ebr informacion<\/em><\/strong>:\n\u00ebsht\u00eb nj\u00eb kusht, p\u00ebrpara shqyrtimit t\u00eb sfer\u00ebs s\u00eb zbatimit t\u00eb Nenit 10, ku\ninformacioni q\u00eb k\u00ebrkohet t\u00eb jet\u00eb i nevojsh\u00ebm p\u00ebr ushtrimin e t\u00eb drejt\u00ebs s\u00eb\nliris\u00eb s\u00eb shprehjes. E drejta e votimit mund t\u00eb konsiderohet si liri e\nshprehjes dhe njohja p\u00ebrpara dat\u00ebs s\u00eb zgjedhjeve me&nbsp; financimet e partive politike \u00ebsht\u00eb parakusht\np\u00ebr zgjedhje t\u00eb lira dhe t\u00eb drejta. Kjo mund t\u00eb vler\u00ebsohet kur mohimi i dh\u00ebnies\ns\u00eb informacionit do t\u00eb pengonte ose d\u00ebmtonte ushtrimin e t\u00eb drejt\u00ebs s\u00eb\nindividit.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">&#8211; <strong><em>Natyra e informacionit t\u00eb k\u00ebrkuar<\/em><\/strong>:\ninformacioni p\u00ebr t\u00eb cilin k\u00ebrkohet akses, n\u00eb p\u00ebrgjith\u00ebsi, duhet t\u00eb p\u00ebrmbush\u00eb\n&#8220;testin e interesit publik&#8221;, n\u00eb m\u00ebnyr\u00eb q\u00eb dh\u00ebnia e tij t\u00eb jet\u00eb i\nnevojsh\u00ebm sipas nenit 10.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\"><strong><em>&#8211; Roli i k\u00ebrkuesit<\/em><\/strong>:\nkur individi k\u00ebrkon akses n\u00eb informim me q\u00ebllim t\u00eb informimit t\u00eb publikut n\u00eb\ncil\u00ebsin\u00eb e tij si v\u00ebzhgues publik ose shoq\u00ebror, kjo do t\u00eb jet\u00eb nj\u00eb vler\u00ebsim i r\u00ebnd\u00ebsish\u00ebm\nn\u00eb p\u00ebrcaktimin n\u00ebse zbatohet Neni 10.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">&#8211; <strong><em>Informacioni i gatsh\u00ebm dhe i disponuesh\u00ebm<\/em><\/strong>:\nshkalla n\u00eb t\u00eb cil\u00ebn informacioni i k\u00ebrkuar \u00ebsht\u00eb i gatsh\u00ebm dhe i disponuesh\u00ebm,\ngjithashtu, do t\u00eb jet\u00eb nj\u00eb kriter i r\u00ebnd\u00ebsish\u00ebm kur p\u00ebrcaktohet n\u00ebse Neni 10\n\u00ebsht\u00eb i zbatuesh\u00ebm p\u00ebr nj\u00eb rast kur nj\u00eb individi i \u00ebsht\u00eb mohuar aksesi n\u00eb\ninformim.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Bazuar n\u00eb k\u00ebto kushte, ju lutem merrni parasysh\nk\u00ebrkes\u00ebn ton\u00eb p\u00ebr t\u00eb shqyrtuar edhe themelin e rastit t\u00eb paraqitur n\u00eb k\u00ebrkes\u00ebn <em>AIS kund\u00ebr Shqip\u00ebris\u00eb<\/em> n\u00eb Gjykat\u00ebn\nEvropiane p\u00ebr t\u00eb Drejtat e Njeriut t\u00eb paraqitur n\u00eb&nbsp; dat\u00ebn 18 maj 2016 lidhur me shkeljen e nenit\n6, nenit 10 dhe nenit 13 t\u00eb Konvent\u00ebs Evropiane.
