Rrjeti elektronik q\u00eb i\nsh\u00ebrben biliona p\u00ebrdoruesve t\u00eb tij n\u00eb mbar\u00eb bot\u00ebn nuk mund t\u00eb jet\u00eb subjekt i t\u00eb\nnj\u00ebjtave rregullime dhe kontrolli. Rreziku i d\u00ebmit q\u00eb paraqitet nga p\u00ebrmbajtja\ndhe komunikimi n\u00eb internet p\u00ebr ushtrimin dhe g\u00ebzimin e t\u00eb drejtave dhe lirive t\u00eb\nnjeriut, \u2026.\u00ebsht\u00eb qart\u00ebsisht m\u00eb i lart\u00eb sesa ai q\u00eb paraqitet nga shtypi.<\/em>\u201d<a href=\"#_ftn2\">[2]<\/a><\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">P\u00ebr m\u00eb tep\u00ebr, n\u00eb \u00e7\u00ebshtjen\n<em>Ahmet Yildirim v Turqis\u00eb,<\/em> Gjykata Europiane e t\u00eb Drejtave t\u00eb Njeriut theksoi\nse \u201c<em>interneti \u00ebsht\u00eb b\u00ebr\u00eb tashm\u00eb nj\u00eb nga mjetet m\u00eb par\u00ebsore p\u00ebr t\u00eb ushtruar t\u00eb\ndrejt\u00ebn e liris\u00eb s\u00eb shprehjes dhe informacionit.<\/em>\u201d<a href=\"#_ftn3\">[3]<\/a>\nPo ashtu Gjykata njohu se \u201c<em>shpifja dhe lloje t\u00eb tjetra t\u00eb fjal\u00ebs s\u00eb\npaligjshme, p\u00ebrfshir\u00eb gjuh\u00ebn e urrejtjes dhe gjuh\u00ebn q\u00eb nxit dhun\u00eb mund t\u00eb shp\u00ebrndahen\nsi kurr\u00eb m\u00eb par\u00eb, n\u00eb mbar\u00eb bot\u00ebn, vet\u00ebm n\u00eb pak sekonda dhe n\u00eb disa raste q\u00ebndrojn\u00eb\np\u00ebrher\u00eb t\u00eb shfaqura n\u00eb media.\u201d<\/em> <a href=\"#_ftn4\">[4]<\/a><\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Gjykata\nEuropiane p\u00ebr t\u00eb Drejtat e Njeriut ka sanksionuar se k\u00ebrkesa e par\u00eb dhe m\u00eb e r\u00ebnd\u00ebsishme\ne nenit 10 t\u00eb Konvent\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeirut \u00ebsht\u00eb se nd\u00ebrhyrja e\n\u00e7do autoriteti publik n\u00eb lidhje me t\u00eb drejt\u00ebn e shprehjes duhet t\u00eb jet\u00eb e\nligjshme. N\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb jet\u00eb n\u00eb p\u00ebrputhje me k\u00ebt\u00eb k\u00ebrkes\u00eb t\u00eb r\u00ebnd\u00ebsishme, nd\u00ebrhyrja\nnuk k\u00ebrkon thjesht nj\u00eb baz\u00eb n\u00eb t\u00eb drejt\u00ebn e brendshme t\u00eb vendit.&nbsp; Ligji vet\u00eb duhet t\u2019i korrespondoj\u00eb disa k\u00ebrkesave\nt\u00eb r\u00ebnd\u00ebsishme t\u00eb \u201ccil\u00ebsis\u00eb\u201d. N\u00eb ve\u00e7anti, nj\u00eb norm\u00eb mund t\u00eb konsiderohet si\nligj vet\u00ebm n\u00eb rastet kur \u00ebsht\u00eb hartuar me precizion q\u00eb t\u2019u mund\u00ebsoj\u00eb shtetasve\nq\u00eb t\u00eb rregullojn\u00eb sjelljen e tyre. <a href=\"#_ftn5\">[5]<\/a>\nMasa e precizionit varet, n\u00eb nj\u00eb mas\u00eb t\u00eb konsiderueshme, n\u00eb p\u00ebrmbajtjen e\ninstrumentit n\u00eb fjal\u00eb, fush\u00ebs p\u00ebr t\u00eb cil\u00ebn ai \u00ebsht\u00eb dizenjuar t\u00eb mbuloj\u00eb, si\ndhe numrit dhe statusit t\u00eb atyre q\u00eb ai iu drejtohet.<a href=\"#_ftn6\">[6]<\/a>\nNd\u00ebrsa nocioni i parashikueshm\u00ebris\u00eb zbatohet jo vet\u00ebm gjat\u00ebs faz\u00ebs s\u00eb\nimplementimit t\u00eb sjelljes, por edhe n\u00eb \u201c<em>formalitet, kushte, kufizimet apo\nsanksionet<\/em>\u201d t\u00eb cilat i bashk\u00eblidhen nj\u00eb sjellje t\u00eb till\u00eb, n\u00ebse koonsiderohen\nsi shkelje e ligjit t\u00eb brendsh\u00ebm t\u00eb vendit.<a href=\"#_ftn7\">[7]<\/a><\/p>\n\n\n\n<p><strong><em>Rekomandime<\/em><\/strong><\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">1. &nbsp;&nbsp;&nbsp;P\u00ebrqasja\np\u00ebr t\u00eb rregulluar c\u00ebshtjen e \u201cshpifjes n\u00eb internet\u201d<a href=\"#_ftn8\">[8]<\/a> n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb\ndhe me t\u00eb nj\u00ebjtin akt ligjor q\u00eb rregullohen media audiovizive dhe komunikimet elektronike,\nnuk \u00ebsht\u00eb e rekomandueshme. Rregullimi i medias audiovizive\/komunikimeve\nelektronike dhe transferimi i rregullimit t\u00eb \u00e7\u00ebshtjes s\u00eb shpifjes edhe n\u00eb fush\u00ebn\ne internetit n\u00eb to \u00ebsht\u00eb nj\u00eb qasje e gabuar legjislative.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">2. &nbsp;&nbsp;T\u00eb drejta e njeriut nuk e p\u00ebrjashtojn\u00eb\nndalimin dhe nd\u00ebshkimin e shpifjes, edhe p\u00ebr sa i p\u00ebrket fush\u00ebs s\u00eb internetit.\nLiria e shprehjes s\u00eb individit zbatohet edhe n\u00eb internet, sikund\u00ebr \u00ebsht\u00eb e\nzbatueshme n\u00eb \u00e7do lloj mjeti tjet\u00ebr t\u00eb komunikimit. Kufizimet jan\u00eb t\u00eb lejueshme\nvet\u00ebm n\u00ebse kalojn\u00eb testin e tre pjes\u00ebve (three &#8211; part test): legalitetin,\nlegjitimitetin dhe proporcionalitetin.&nbsp; Nd\u00ebrhyrjet\nn\u00eb lirin\u00eb e shprehjes jan\u00eb legjitime n\u00ebse: a) parashikohen me ligj, b) ndjekin\nq\u00ebllim t\u00eb ligjsh\u00ebm; c) jan\u00eb t\u00eb nevojshme ne nj\u00eb shoqri demokratike.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">3.\n&nbsp;&nbsp;Bazuar n\u00eb sa m\u00eb sip\u00ebr AIS \u00ebsht\u00eb e\nmendimit se autoritetet publike kan\u00eb t\u00eb gjith\u00eb \u201c<em>hap\u00ebsir\u00ebn e vler\u00ebsimit<\/em>\u201d\np\u00ebr t\u00eb rregulluar me ligj \u00e7\u00ebshtjen e shpifjes n\u00eb internet. Gjithsesi, kjo \u00e7\u00ebshtje\nduhet t\u00eb rregullohet vet\u00ebm me nj\u00eb ligj t\u00eb vecant\u00eb &nbsp;&#8211; ligj integral &#8211; q\u00eb i dedikohet dhe mbulon vet\u00ebm\nk\u00ebt\u00eb \u00e7\u00ebshtje e pavendosur dhe shtuar\/ndryshuar ligje t\u00eb tjera, qofshin k\u00ebto t\u00eb\nfundit n\u00eb lidhje komunikimet elektronike. Modeli i Defamation Act 2013 n\u00eb Mbret\u00ebrin\u00eb\ne Bashkuar mund t\u00eb sh\u00ebrbej\u00eb si model i vlefsh\u00ebm p\u00ebr p\u00ebrmbajtjen dhe teknik\u00ebn\nlegjislative t\u00eb rekomandueshme n\u00eb k\u00ebt\u00eb rast.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">4.&nbsp; Ligji i ri integral nuk duhet t\u00eb ket\u00eb si q\u00ebllim\nn\u00eb vetvete nd\u00ebshkimin, por p\u00ebrcaktimin e alternativave zhvilluese, p\u00ebrqasje t\u00eb specifikuara\ndhe efektive ligjore, t\u00eb cilat jan\u00eb t\u00eb p\u00ebrshtatshme p\u00ebr karakteristikat unike t\u00eb\ninternetit. &nbsp;Vet\u00ebrregulli\nduhet t\u00eb jet\u00eb i parashikuar si nj\u00eb mjet efektiv p\u00ebr t\u2019iu adresuar gjuh\u00ebs s\u00eb\nurrejtjes, shpifjes, ekstremizmit, etj dhe si i till\u00eb duhet t\u00eb promovohet. <\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Rritja e nd\u00ebrgjegj\u00ebsimit dhe p\u00ebrpjekjet edukuese p\u00ebr t\u00eb\npromovuar mund\u00ebsin\u00eb e gjith\u00ebsecilit p\u00ebr t\u2019iu p\u00ebrfshir\u00eb n\u00eb m\u00ebnyr\u00eb autonome, vet\u00ebnxit\u00ebse\ndhe n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrgjegjshme n\u00eb internet duhet t\u00eb jet\u00eb element p\u00ebrb\u00ebr\u00ebs i\nligjit t\u00eb ri integral. N\u00eb k\u00ebt\u00eb drejtim sipas s\u00eb drejt\u00ebs nd\u00ebrkomb\u00ebtare shteti ka\nnj\u00eb s\u00ebr\u00eb detyrimesh pozitive q\u00eb duhet t\u00eb p\u00ebrmbush\u00eb. Ky komponent njihet ndryshe\nsi \u201c<em>internet literacy<\/em>\u201d.<\/p>\n\n\n\n<p<p style=\"text-align: justify; line-height: 18.0pt;\">5.&nbsp; &nbsp;&nbsp;Gjuha e p\u00ebrdorur n\u00eb tekstet e neneve duhet t\u00eb\nrishikohet. Afatet e parashikuara n\u00eb projektligj jan\u00eb t\u00eb tilla dhe fillojn\u00eb\npsh: <em>K\u00ebrkesa p\u00ebr t\u00eb drejt\u00ebn e p\u00ebrgjigjes\nduhet t\u00eb paraqitet tek OSHPE-ja brenda 7 dit\u00ebsh nga publikimi i fakteve dhe\ninformacioneve q\u00eb pretendohen jo t\u00eb sakta.<\/em> N\u00eb rast se shkelet ky afat k\u00ebrkesa\nnuk paraqitet ose edhe kur paraqitet nuk merret ne shqyrtim.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Afati n\u00eb k\u00ebt\u00eb nen dhe n\u00eb nene t\u00eb tjera nuk duhet lidhet\nme dat\u00ebn e publikimit t\u00eb informacionit, por me dat\u00ebn e marrjes dijeni nga\nankimuesi dhe prov\u00ebs se kur ai ka marr\u00eb dijeni. Psh nj\u00eb person mund t\u00eb vihet n\u00eb\ndijeni se ndaj tij \u00ebsht\u00eb b\u00ebr\u00eb shpifje nga nj\u00eb portal me nj\u00eb muaj vones\u00eb (sepse\npersoni nuk sheh fare portale) dhe jo brenda disa dit\u00ebsh nga publikimi, si\u00e7 e\nparashikon ligji.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">6.&nbsp; &nbsp;Ligji i ri integral (sikund\u00ebr edhe dy\nprojektligjet n\u00eb konsultim) duhet t\u00eb eleminoj\u00eb sa m\u00eb t\u00eb tep\u00ebr q\u00eb t\u00eb jet\u00eb e\nmundur fjal\u00eb t\u00eb p\u00ebrgjithshme. Psh cfare do t\u00eb thot\u00eb informacione \u201c<em>jo t\u00eb sakta p\u00ebr nj\u00eb person<\/em>\u201d ose \u201c<em>Ofruesi i sh\u00ebrbimit t\u00eb publikimit elektronik\nduhet t\u00eb siguroj\u00eb q\u00eb trajtimi i ngjarjeve p\u00ebrfshir\u00eb c\u00ebshtjet q\u00eb jan\u00eb tema t\u00eb\ndebatit publik, t\u00eb jet\u00eb i drejt\u00eb p\u00ebr t\u00eb gjith\u00eb subjektet e interesuara n\u00eb k\u00ebto\nc\u00ebshtje dhe t\u00eb paraqitet n\u00eb m\u00ebnyr\u00eb t\u00eb v\u00ebrtet\u00eb dhe t\u00eb paanshme<\/em>.\u201d Ky p\u00ebrcaktim\n\u00ebsht\u00eb i v\u00ebshtir\u00eb q\u00eb t\u00eb kuptohet dhe p\u00ebr m\u00eb tep\u00ebr edhe t\u00eb zbatohet. N\u00eb rast se\nnj\u00eb person hap blogun e vet dhe shpreh mendimet e tij psh p\u00ebr t\u00eb kund\u00ebrshtuar\nhyrjen n\u00eb Bashkimin Europian t\u00eb Shqip\u00ebris\u00eb ateher\u00eb si duhet t\u00eb rregulloj\u00eb\nsjelljen e vet ky bloger p\u00ebr t\u00eb q\u00ebn\u00eb i v\u00ebrtet\u00eb dhe i paansh\u00ebm??!!. Blogu n\u00eb\ninternet sipas parashikimeve t\u00eb t\u00eb dy projekligjeve p\u00ebrfshihet n\u00eb fush\u00ebn e\nveprimit t\u00eb tyre. <\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Shprehje t\u00eb tjera t\u00eb p\u00ebrgjithshme t\u00eb p\u00ebrdorura n\u00eb\nprojekligje, dhe q\u00eb ndikojn\u00eb n\u00eb standartin e precizionit t\u00eb k\u00ebrkuar nga ana e Gjykat\u00ebs\nEuropiane p\u00ebr t\u00eb Drejtat e Njeriut q\u00eb k\u00ebrkojn\u00eb rishikim jan\u00eb \u201cOfruesi i sh\u00ebrbimit\nt\u00eb publikimit elektronik: nuk duhet t\u00eb c\u00ebnoj\u00eb dinjitetin dhe t\u00eb drejtat\nthemelore t\u00eb njeriut\u201d, ose \u201ct\u00eb respektoj\u00eb rregullat e moralit publik\u201d; ose \u201ct\u00eb\nmos c\u00ebnoj\u00eb sigurin\u00eb e publikut\u201c, etj. etj.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">7.&nbsp; &nbsp;Ligji i ri integral dhe parashikimet e b\u00ebra n\u00eb\ndy projekligjet n\u00eb konsultim nuk duhet t\u00eb vendos\u00eb rregjistrimin e medias online,\nn\u00eb cdo form\u00eb t\u00eb saj, si kusht p\u00ebr t\u00eb operuar k\u00ebto t\u00eb fundit n\u00eb m\u00ebnyr\u00eb t\u00eb lir\u00eb.\n\u00cbsht\u00eb kuptueshme q\u00eb kushte rregjistrimi n\u00eb AKEP (ose kudo tjet\u00ebr) mund t\u00eb\nvendose psh n\u00eb rast se k\u00ebto portale aplikojn\u00eb p\u00ebr t\u00eb marr\u00eb ndihm\u00eb financiare nga\nshteti, por n\u00eb cdo rast rregjistrimi duhet t\u00eb jet\u00eb i thjesht\u00eb, me procedur\u00eb\ntransparente dhe e paanshme politikisht, si dhe n\u00eb cdo rast t\u00eb mos ndikoj\u00eb n\u00eb\npavar\u00ebsin\u00eb editoriale. <\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">8.&nbsp; AIS vler\u00ebson se i vetmi institucion q\u00eb mund dhe\nduhet t\u00eb urdh\u00ebroj\u00eb bllokimin\/pezullimin<a href=\"#_ftn9\">[9]<\/a> duhet t\u00eb jet\u00eb vet\u00ebm\ngjykata e rrethit gjyq\u00ebsor p\u00ebrkat\u00ebs, seksioni civil. Nuk ka arsye, sikund\u00ebr\nparashikohet n\u00eb projekligj, t\u00eb shtohet nj\u00eb rrug\u00eb tjet\u00ebr ajo administrative. P\u00ebr\nm\u00eb tep\u00ebr m\u00eb procedurat e vettingut n\u00eb gjyq\u00ebsor &#8211; q\u00eb jan\u00eb n\u00eb realizim e sip\u00ebr &#8211; shtojn\u00eb\ngarancit\u00eb p\u00ebr vendimmarrje nga nj\u00eb gjyq\u00ebsor i pavarur jasht\u00eb ndikimit politik dhe\nprofesional edhe n\u00eb k\u00ebt\u00eb fush\u00eb. Ligji i ri integral duhet t\u00eb p\u00ebrmbaj\u00eb edhe p\u00ebr\ngjykat\u00ebn n\u00eb detaje dispozita q\u00eb t\u00eb garantoj\u00eb &nbsp;proces t\u00eb rregullt gjyq\u00ebsor. N\u00eb k\u00ebt\u00eb fush\u00eb\nrregullime t\u00eb procedurave gjyq\u00ebsore jashte kodit t\u00eb procedur\u00ebs civile jan\u00eb\naplikuar edhe n\u00eb rastin e ligjit \u201cP\u00ebr masat ndaj dhun\u00ebs n\u00eb familje\u201d. P\u00ebr pasoj\u00eb\nprocedura t\u00eb shpejta, efektive, transparente dhe n\u00eb p\u00ebrmbushje t\u00eb procesit t\u00eb\nrregullt gjyq\u00ebsor jan\u00eb t\u00eb mundshme t\u00eb parashikohen n\u00eb k\u00ebt\u00eb ligjin e vecant\u00eb\nintegral. Vendimi i bllokimit\/pezullimit do t\u00eb jet\u00eb si cdo vendim gjyq\u00ebsor i\narsyetuar dhe ku do t\u00eb parashikohen edhe m\u00ebnyrat e ankimit t\u00eb tij. <\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">Masa e pezullimit t\u00eb p\u00ebrkohsh\u00ebm gjithashtu duhet t\u00eb jepet me vendim t\u00eb arsyetuar t\u00eb gjykat\u00ebs. Ligji i ri integral, p\u00ebr cdo faze shqyrtimi gjyq\u00ebsor, duhet t\u00eb parashikoj\u00eb afate t\u00eb shpejta dhe efikase gjykimi dhe vendimmarrjeje.<\/p>\n\n\n\n<p style=\"text-align: justify; line-height: 18.0pt;\">9.&nbsp; &nbsp;&nbsp;Ligji i ri integral duhet t\u00eb parashikoj\u00eb se\nmasa e bllokimit\/pezullimit t\u00eb aksesit n\u00eb faqe t\u00eb caktuara internet p\u00ebrb\u00ebn mas\u00ebn\nshum\u00eb serizoe t\u00eb nd\u00ebrhyrjes me lirin\u00eb e shprehjes. Si e till\u00eb masa e bllokimit\nduhet t\u00eb konsiderohet me ligj si masa e fundit ekstreme q\u00eb mund t\u00eb nd\u00ebrmerret\nvet\u00ebm n\u00eb raste t\u00eb mir\u00ebspecifikuara n\u00eb ligj dhe q\u00eb justifikojn\u00eb nj\u00eb gj\u00eb t\u00eb till\u00eb.\nK\u00ebto masa mungojn\u00eb n\u00eb tekstin e projektligjit, sepse lidhen vet\u00ebm me nj\u00eb kriter\nnumerik t\u00eb kund\u00ebrvajtjes administrative, e cila v\u00ebshtir\u00eb se kalon testin e\nshkeljes ekstreme. <\/p>\n\n\n\n<p style=\"text-align: justify;
