{"id":15748,"date":"2020-04-09T08:25:48","date_gmt":"2020-04-09T08:25:48","guid":{"rendered":"http:\/\/ais.al\/new\/?p=15748"},"modified":"2020-07-22T09:09:46","modified_gmt":"2020-07-22T09:09:46","slug":"blerje-per-situaten-covid-19-qeveria-shqiptare-aplikon-kontrata-sekrete-i-shmanget-pjesemarrjes-dhe-transparences","status":"publish","type":"post","link":"https:\/\/ais.al\/new\/blerje-per-situaten-covid-19-qeveria-shqiptare-aplikon-kontrata-sekrete-i-shmanget-pjesemarrjes-dhe-transparences\/","title":{"rendered":"Blerje p\u00ebr Situat\u00ebn Covid-19, Qeveria Shqiptare aplikon  Kontrata Sekrete, i shmanget Pjes\u00ebmarrjes dhe Transparenc\u00ebs"},"content":{"rendered":"<p>Organizata AIS promotore e Open Data Albania. v\u00ebren me shqet\u00ebsim se Qeveria Shqiptare n\u00eb m\u00ebnyre antikushtetuese, n\u00eb paligjm\u00ebri dhe pa asnj\u00eb nevoj\u00eb t\u00eb p\u00ebrligjur ka vendosur t\u00eb konsideroj\u00eb Sekret kontraktimet dhe procedurat p\u00ebr blerje gjat\u00eb emergjenc\u00ebs s\u00eb krijuar p\u00ebr shkak t\u00eb Covid-19.<\/p>\n<ul>\n<li>P\u00ebrmes dy Vendimeve t\u00eb K\u00ebshillit t\u00eb Ministrave (VKM) konkretisht: VKM Nr. 203, dat\u00eb 26.02.2020 \u201cP\u00ebr procedurat q\u00eb p\u00ebrdoren p\u00ebr Lidhjen e Kontratave q\u00eb Diktohen nga Interesa Thelb\u00ebsor t\u00eb Shtetit\u201d dhe Ndryshimeve t\u00eb b\u00ebra me VKM nr. 242 dat\u00eb 22.03.2020 \u201cP\u00ebr disa shtesa n\u00eb Vendimin nr 203, K\u00ebshilli i Ministrave i barazon procedurat dhe kontraktimet p\u00ebr shkak t\u00eb Covid-19 si\u00a0 Kontraktime Sekrete.<\/li>\n<li>Kjo VKM \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me Kushtetut\u00ebn. Kushtetuta e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb n\u00eb nenin 118 pika 2 t\u00eb parashikon se: \u201cLigji duhet t\u00eb autorizoj\u00eb nxjerrjen e akteve n\u00ebnligjore, t\u00eb p\u00ebrcaktoj\u00eb organin kompetent, \u00e7\u00ebshtjet q\u00eb duhen rregulluar, si dhe parimet n\u00eb baz\u00eb t\u00eb t\u00eb cilave nxirren k\u00ebto akte\u201d. Neni 6 i Ligjit t\u00eb Prokurimit Publik (ku \u00ebsht\u00eb mb\u00ebshtetur KM p\u00ebr nxjerrjen e k\u00ebsaj VKM) nuk autorizon nxjerrjen e nj\u00eb Akti Normativ t\u00eb Ve\u00e7ant\u00eb p\u00ebr kontratat sekrete, kontratat q\u00eb k\u00ebrkojn\u00eb masa t\u00eb ve\u00e7anta sigurie dhe kontratat q\u00eb diktohen nga interesa thelb\u00ebsor\u00eb t\u00eb shtetit. VKM nr. 203 nuk ka p\u00ebrcaktuar p\u00ebrkufizimin e gjendjes, rrethanave, apo rasteve kur kemi t\u00eb b\u00ebjm\u00eb me \u201cinteresa thelb\u00ebsor\u00eb t\u00eb shtetit\u201d por k\u00ebto rrethana i ka l\u00ebn\u00eb rast pas rasti n\u00eb vler\u00ebsim t\u00eb autoriteteve kontraktore; Pra e th\u00ebn\u00eb shkurt, kushtet kur termi \u201cinteresa thelb\u00ebsor\u00eb t\u00eb shtetit\u201d nuk ka gjetur nj\u00eb rregullim ligjor, ngelet nj\u00eb situat\u00eb abstrakte e pa p\u00ebrkufizuar dhe n\u00eb vler\u00ebsimin subjektiv t\u00eb \u00e7do autoriteti duke rritur riskun p\u00ebr Arbitraritet.<\/li>\n<\/ul>\n<ul>\n<li>Vendimet e K\u00ebshillit t\u00eb Ministrave t\u00eb sip\u00ebrcituara krijojn\u00eb situata ku klienti p\u00ebrzgjidhet pa publikim dhe thirrje p\u00ebr shprehje interesi, \u00e7ka b\u00ebn t\u00eb pamundur identifikimin dhe k\u00ebrkimin p\u00ebr operator eficent. N\u00eb k\u00ebt\u00eb koh\u00eb krize, mund\u00ebsit\u00eb p\u00ebr furnizime jan\u00eb t\u00eb limituara dhe t\u00eb karakterizuara nga ndryshime dinamike. Shum\u00eb po aplikojn\u00eb forma inovatore p\u00ebr t\u00eb b\u00ebr\u00eb gjurmim dhe evidentim n\u00eb koh\u00eb sa m\u00eb t\u00eb shpejt\u00eb t\u00eb furnitor\u00ebve Leader, t\u00eb cil\u00ebt garantojn\u00eb mallra n\u00eb situat\u00ebn s\u00eb krijuar. K\u00ebta furnitor, Qeverit\u00eb nuk mund ti gjurmojn\u00eb duke komunikuar me nj\u00eb klient t\u00eb vet\u00ebm pa l\u00ebn\u00eb asnj\u00eb mund\u00ebsi prezantimi dhe pjes\u00ebmarrje. Kjo p\u00ebrqasje cenon \u00e7do Parim t\u00eb Pjes\u00ebmarrjes dhe Konkurrenc\u00ebs.<\/li>\n<\/ul>\n<ul>\n<li>Qeveria ka b\u00ebr\u00eb nj\u00eb nd\u00ebrhyrje t\u00eb pap\u00ebrligjur sa koh\u00eb q\u00eb Legjislacioni Shqiptar (Ligji nr. 9643\/2016) ka t\u00eb rregulluar mjaft mir\u00eb Procedur\u00ebn e Negocimit dhe Procedur\u00ebn e Kufizuar, \u00e7ka do t\u00eb ofronin blerje t\u00eb shpejta, eficente dhe t\u00eb dobishme pa qen\u00eb nevoja p\u00ebr veprime sekrete. K\u00ebto dy procedura t\u00eb parashikuara n\u00eb Legjislacionin komb\u00ebtar e garantojn\u00eb mund\u00ebsin\u00eb p\u00ebr furnizime n\u00eb situata emergjencash dhe fatkeq\u00ebsish, duke krijuar garanci t\u00eb Proporcionalitetit.<\/li>\n<li>Nga ana tjet\u00ebr t\u00eb gjith\u00eb element\u00ebt e kontrat\u00ebs si objekti i blerjes; \u00e7mimi; karakteristikat dhe specifikat e mallit apo sh\u00ebrbimit q\u00eb blihet, duke qen\u00eb sekret nuk i n\u00ebnshtrohen Publikimit; Transparenc\u00ebs; Llogaridh\u00ebnies me q\u00ebllim Besimin dhe Kontrollin Publik.<\/li>\n<li>Shkelet Parimi i Qeverisjes s\u00eb Hapur Transparente. Qeveria Shqiptare po shmang parimin e Qeverisjeve t\u00eb Hapura (Open Government). Kjo n\u00eb nj\u00eb moment q\u00eb Legjislacionet e Reformuar n\u00eb Sektorin e Kontraktimeve n\u00eb disa vende evropiane dhe jo vet\u00ebm, kan\u00eb t\u00eb sanksionuar n\u00eb Ligj detyrimin q\u00eb t\u00eb Gjitha kontratat e Rasteve t\u00eb Emergjencave duhet t\u00eb publikohen t\u00eb plota n\u00eb formatin e Hapur (open data). Kujtojm\u00eb q\u00eb Shqip\u00ebria q\u00eb prej vitit 2009 \u00ebsht\u00eb pjes\u00eb e Partneritetit P\u00ebr Qeverisje t\u00eb Hapura OGP duke nd\u00ebrmarr\u00eb angazhime t\u00eb ve\u00e7anta n\u00eb kontekstin e Sektorit t\u00eb Prokurimeve, angazhime t\u00eb paplot\u00ebsuara.<\/li>\n<\/ul>\n<ul>\n<li>Klasifikimi sekret p\u00ebr shkak t\u00eb interesave thelb\u00ebsore t\u00eb shtetit i k\u00ebtyre kontratave (procedurave), bie ndesh edhe me vet\u00eb Aktin Normativ t\u00eb Qeveris\u00eb P\u00ebr Shpalljen e Gjendjes s\u00eb Fatkeq\u00ebsis\u00eb Natyrore, akt ku nuk ka parashikim p\u00ebr kufizime t\u00eb t\u00eb Drejt\u00ebs Kushtetuese p\u00ebr Informim (neni 23 Kushtetuta).<\/li>\n<\/ul>\n<p>Organizata jon\u00eb konsideron k\u00ebto veprime t\u00eb Qeveris\u00eb si antikushtetues, jo ligjore, jo t\u00eb p\u00ebrligjura\u00a0 dhe n\u00eb cenim t\u00eb parimeve baz\u00eb t\u00eb mir\u00ebqeverisjes q\u00eb jan\u00eb Llogaridh\u00ebnia dhe Transparenca.
