Padia e formuluar nga organizata jon\u00eb q\u00eb punon p\u00ebr llogaridh\u00ebnie, transparenc\u00eb dhe antikorrupsion <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/ndiqparate.al\/wp-content\/uploads\/2022\/01\/Vendim-nr-132-dt-15-Nen-21-Gj-Kushtetuese.pdf\">nuk u legjitimua<\/a><\/span> pasi Relatoria e \u00e7\u00ebshtjes \u00a0argumentoi se nj\u00eb organizat\u00eb mund t\u00eb K\u00ebrkoj\u00eb Interpretim Kushtetues, por kjo vet\u00ebm n\u00eb rastet q\u00eb an\u00ebtar\u00ebt e saj kan\u00eb interesa t\u00eb drejtp\u00ebrdrejta me k\u00ebrkimin.<\/p>\r\n\r\n\r\n\r\n<p>Mendojm\u00eb q\u00eb ky ishte nj\u00eb moment Regresi ku Gjykata Kushtetuese nuk legjitimon t\u00eb drejt\u00ebn e Organizatave me mision dhe objekt \u00e7\u00ebshtje t\u00eb Mir\u00ebqeverisjes dhe Antikorusionit. Kushtetuta i njeh Organizatat si subjekte q\u00eb kan\u00eb t\u00eb drejt\u00eb t\u00eb k\u00ebrkojn\u00eb Kontroll Kushtetues Neni 134 pika h Kushtetuta. Dhe interesi n\u00eb k\u00ebrkim nuk ka pse t\u00eb jet\u00eb individual kundrejt interesit p\u00ebr t\u00eb cilin ka Mision OJF-ja.<\/p>\r\n\r\n\r\n\r\n<p>Me d\u00ebshir\u00ebn p\u00ebr t\u00eb nd\u00ebrprer\u00eb veprimin e ligjit klientelist, organizata k\u00ebrkoi bashk\u00ebpunimin e aktor\u00ebve t\u00eb tjer\u00eb q\u00eb legjitimohen menj\u00ebher\u00eb si subjekte q\u00eb v\u00ebn\u00eb n\u00eb L\u00ebvizje Kontrollin Kushtetues.<\/p>\r\n\r\n\r\n\r\n<p>K\u00ebrkes\u00ebs ton\u00eb ju p\u00ebrgjigj\u00ebn 28 deputet opozitar t\u00eb cil\u00ebt rid\u00ebrguan n\u00eb Janar 2022 <a href=\"http:\/\/ais.al\/new\/gjykata-kushtetuese-te-shfuqizoje-ligjin-korruptiv-partia-demokratike-mbeshtet-padine-e-pergatitur-nga-shoqeria-civile\/\">Padin\u00eb n\u00eb Gjykat\u00eb<\/a>. K\u00ebt\u00eb her\u00eb Gjykata e Pranoi Shqyrtimin e Padis\u00eb dhe Filloi shqyrtim t\u00eb fakteve n\u00eb Seanc\u00eb Plenare n\u00eb Korrik 2022.<\/p>\r\n\r\n\r\n\r\n<p>Por n\u00eb korrik 2022, Gjykata Kushtetuese funksionoi me nj\u00eb num\u00ebr t\u00eb limituar t\u00eb an\u00ebtar\u00ebve, vet\u00ebm 7 nga 9 an\u00ebtar\u00eb t\u00eb saj ishin n\u00eb detyr\u00eb. Vonesat n\u00eb Em\u00ebrimin e Vakancave d\u00ebmtuan eficens\u00ebn e Gjykat\u00ebs.<\/p>\r\n\r\n\r\n\r\n<p>N\u00eb nj\u00eb raport 4 gjyqtar pro dhe 3 kund\u00ebr, Padia megjith\u00ebse u votua nga shumica (4 an\u00ebtar\u00eb nga 7 n\u00eb seanc\u00eb plenare) nuk arriti t\u00eb shfuqizoj\u00eb k\u00ebt\u00eb ligj. N\u00eb nj\u00eb gar\u00eb t\u00eb hapur nj\u00eb biznes q\u00eb nuk ka Pun\u00eb t\u00eb Ngjashme n\u00eb Nd\u00ebrtim, nuk do t\u00eb mund t\u00eb kualifikohej si Konkurrent i Suksessh\u00ebm. Ligji q\u00eb pengon konkurrenc\u00ebn e lir\u00eb mund\u00ebsoi k\u00ebt\u00eb penetrim klientelist.<\/p>\r\n\r\n\r\n\r\n<p>Procedura pa gar\u00eb, e kufizuar, dhe me negocim jasht\u00eb sistemin elektronik \u00ebsht\u00eb parashikuar pik\u00ebrisht me ligjin q\u00eb duhej shfuqizuar.<\/p>\r\n\r\n\r\n\r\n<p>Vet\u00ebm pas dh\u00ebnies s\u00eb Kontratave Publike Prokuroria e Posa\u00e7me p\u00ebr Antikorrupsionin <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/aksesdrejtesi.al\/listAktNormativ\/902\">SPAK<\/a> <\/span>veproi duke k\u00ebrkuar sekuestrim t\u00eb Bizneseve. Por fati i kontratave publike dhe p\u00ebrgjegj\u00ebsia e atyre q\u00eb m\u00ebn\u00ebsuan k\u00ebt\u00eb situat\u00eb ku shteti b\u00ebhet partner kontraktor me subjekte me rekorde kriminale, mbeten \u00e7\u00ebshtje pa rregullim dhe pa hetim penal.<\/p>\r\n\r\n\r\n\r\n<p>Korrupsioni me Ligj \u00ebsht\u00eb favorizuar\u00a0 vitet e fundit n\u00eb Munges\u00eb t\u00eb Gjykat\u00ebs Kushtetuese; Vakancave t\u00eb saj dhe Eficens\u00ebs s\u00eb Munguar n\u00eb Shqyrtimin e rasteve.<\/p>\r\n\r\n\r\n\r\n<p>Sa m\u00eb lart, Gjykata Kushtetuese duhet t\u00eb ushtroj\u00eb rol n\u00eb kontrollin e pajtueshm\u00ebris\u00eb s\u00eb Ligjeve me Kushtetut\u00ebn.
