Po nj\u00ebsoj AIS <strong>vler\u00ebson<\/strong> se Draft Ligji nuk i p\u00ebrgjigjet nevoj\u00ebs p\u00ebr <strong>rregullim m\u00eb t\u00eb mir\u00eb ligjor<\/strong>e dhe <strong>parashikime ligjore pa munges\u00eb<\/strong>, nevoja k\u00ebto t\u00eb referuara n\u00eb eksperiencat me risk q\u00eb Shqip\u00ebria ka sh\u00ebnuar n\u00eb dekad\u00ebn e fundit gjat\u00eb aplikimit t\u00eb PPP dhe Koncesione. Aktualisht 7 nga 15 kontrata koncesion PPP me mb\u00ebshtetje nga Buxheti i Shtetit jan\u00eb <strong>n\u00ebn hetim<\/strong> nga Prokuroria Speciale Antikorruspion.<\/p>\n<p id=\"block-ddb15f4a-e6ec-48b5-b716-c627e4d46ce1\" class=\"block-editor-block-list__block wp-block rich-text block-editor-rich-text__editable wp-block\" tabindex=\"0\" role=\"textbox\" aria-label=\"Paragraph block\" aria-multiline=\"true\" data-block=\"ddb15f4a-e6ec-48b5-b716-c627e4d46ce1\" data-type=\"core\/paragraph\" data-title=\"Paragraph\">N\u00eb finale AIS <strong>sugjeron<\/strong>, rikthim t\u00eb draftit n\u00eb Grup Pune, <strong>Zgjerim i Grupit t\u00eb Pun\u00ebs<\/strong> me Institucione q\u00eb jan\u00eb pjes\u00eb e Fush\u00ebs s\u00eb Zbatimit, Organizim t\u00eb <strong>tryezave apo platformave<\/strong> me P\u00ebrfaq\u00ebsues t\u00eb Shoq\u00ebris\u00eb Civile dhe P\u00ebrfaq\u00ebsues t\u00eb Qeverisjes Lokale. Hartim i nj\u00eb Relacioni mbi P\u00ebrputhshm\u00ebrin\u00eb e Draft Ligjit me Direktivat q\u00eb n\u00eb faz\u00ebn e Hartimit nga Grupi i Pun\u00ebs.<\/p>\n<p id=\"block-54efff6e-d618-46e1-a5d1-ef99eb5a950f\" class=\"block-editor-block-list__block wp-block rich-text block-editor-rich-text__editable wp-block\" tabindex=\"0\" role=\"textbox\" aria-label=\"Paragraph block\" aria-multiline=\"true\" data-block=\"54efff6e-d618-46e1-a5d1-ef99eb5a950f\" data-type=\"core\/paragraph\" data-title=\"Paragraph\">Disa nga paqart\u00ebsit\u00eb apo parregullsit\u00eb e ligjit t\u00eb referuara nga organziata AIS promotore e Open Data Albania jan\u00eb si vijon:<\/p>\n<ul id=\"block-ca47af14-b462-46ac-b6ff-0cac760f229c\" class=\"block-editor-block-list__block wp-block rich-text block-editor-rich-text__editable wp-block\" tabindex=\"0\" role=\"textbox\" aria-label=\"Write list\u2026\" aria-multiline=\"true\" data-block=\"ca47af14-b462-46ac-b6ff-0cac760f229c\" data-type=\"core\/list\" data-title=\"List\">\n<li><strong>Fusha e Zbatimit t\u00eb Ligjit<\/strong> (neni 4), parashikon nj\u00eb zgjerim t\u00eb sektor\u00ebve dhe institucioneve q\u00eb mund t\u00eb angazhohen ne PPP apo Koncesione. Ky nen parashikon PPP\/Koncesion edhe n\u00eb Shkenc\u00eb dhe Arsim; Teknologji Informacioni dhe Infrastruktur\u00eb e baz\u00ebs s\u00eb t\u00eb dh\u00ebnave; Burgje dhe Infrastruktur\u00eb Gjyq\u00ebsor\u00eb. Nuk \u00ebsht\u00eb i qart\u00eb modeli i mar\u00eb p\u00ebr tu aplikuar. Po nj\u00ebsoj nuk jan\u00eb konsultuar Institucione t\u00eb Shkenc\u00ebs; Siguris\u00eb; Drejt\u00ebsis\u00eb. Rekomandohet rishikim dhe konsultim me institucione q\u00eb preken.<\/li>\n<li><strong>PPP dhe Koncesione sipas modelit Shqip\u00ebria 1 Euro<\/strong>. Neni 4 pika 3 ka p\u00ebrmbajtje t\u00eb ekzagjeruar. Koncepti Koncesion me \u00e7mim 1 euro nuk duhet n\u00eb Legjislacionin PPP e Koncesione. Zgjidhjet Shqip\u00ebria 1 Euro jan\u00eb aplikuar p\u00ebr t\u00eb t\u00ebrhequr investitor por kjo nuk duhet t\u00eb p\u00ebrfshihet n\u00eb kontrata afatgjata. Mungon nj\u00eb model i tille ne legjislacion vende EU.<\/li>\n<li>Neni 4, <strong>Fusha e Zbatimit i jep K\u00ebshillit t\u00eb Ministrave Kompetenca t\u00eb tepruara<\/strong>. N\u00eb nenin 4 pika 2, i \u00ebsht\u00eb l\u00ebn\u00eb K\u00ebshillit t\u00eb Ministrave kompetenc\u00eb e lir\u00eb t\u00eb tejkaloj\u00eb rregullimet ligjor. Nuk ka kuptim t\u00eb kemi nj\u00eb Fushe Zbatimi te p\u00ebrcaktuar me Ligj e m\u00eb tej ti lejohet ekzekutivit ta zgjeroje k\u00ebt\u00eb fush\u00eb.<\/li>\n<li><strong>Transparenca dhe Aksesi i Publikut n\u00eb Informacion<\/strong>. Regjistri i PPP Koncesione (Neni 15) nuk ka rregullim t\u00eb duhur q\u00eb garanton transparenc\u00eb dhe akses t\u00eb publikut n\u00eb sektorin PPP Koncesione. Neni \u00ebsht\u00eb shum\u00eb i shkurt\u00ebr dhe nuk jep garanci t\u00eb mir\u00eb parashikuara p\u00ebr akses t\u00eb kurdohersh\u00ebm p\u00ebr publikun. Gjithashtu Draft Ligji parashikon n\u00eb m\u00ebnyr\u00eb t\u00eb cil\u00ebsuar kompetenc\u00ebn e Partnerit Privat p\u00ebr t\u00eb vendosur mbi p\u00ebrmbajtje t\u00eb Kontrat\u00ebs ku aplikohet konfidencialiteti dhe sekreti tregtar (vendimmarrje e nj\u00ebanshme).<\/li>\n<li><strong>Funksionimi i Agjencis\u00eb.<\/strong> Neni 12 Agjencia e Trajtimit t\u00eb Koncesioneve, n\u00eb pik\u00ebn 4 dhe 5 ka parashikime jo t\u00eb qarta mbi funksionimin financiar t\u00eb Agjencis\u00eb qw mbik\u00ebqyr Koncesionet ATRAKO ku \u00ebsht\u00eb parashikuar buxhetim jo drejtp\u00ebrdrejt\u00eb publik, parashikohet funksionim buxhetor me donacione. Kjo nuk ka sens p\u00ebr nj\u00eb institucion me kompetenca publike.<\/li>\n<li><strong>Propozimet e Pak\u00ebrkuara.<\/strong> Neni 19 pika d. Lejon Propozimet e Pak\u00ebrkuara n\u00eb disa sektor. Duhet minimizuar mund\u00ebsia p\u00ebr aktivizim t\u00eb Propozimeve t\u00eb Pak\u00ebrkuara.<\/li>\n<li>Mungon n\u00eb Relacion nj\u00eb Kalendar me Parashikime se sa koh\u00eb duhet <strong>p\u00ebr plot\u00ebsim t\u00eb ligjit me akte n\u00ebnligjor\u00eb<\/strong> dhe a \u00ebsht\u00eb e mundur t\u00eb b\u00ebhet kjo n\u00eb afate ligjore sipas parashikimeve n\u00eb Dispozita Kalimtare. Ligji nuk mund te veproj\u00eb pa u miratuar aktet n\u00ebnligjore.<\/li>\n<li>Gjitashtu ligjit i mungon <strong>kriteri i kontrollit t\u00eb integritetit t\u00eb Pronarit P\u00ebrfitues<\/strong> pasi nuk ka v\u00ebn\u00eb asnj\u00eb klauzol\u00eb transparence apo klauzol\u00eb ku <strong>paketa e kontrollit t\u00eb aksioneve t\u00eb Partnerit Privat t\u00eb jet\u00eb e njohur dhe e autorizuar<\/strong> n\u00eb rast tjet\u00ebrsimi me ndryshime n\u00eb Regjistrin Tregtar Shqiptar apo ndryshime n\u00eb Regjistra Tregtar t\u00eb Huaj.<\/li>\n<li><strong>Fleksibilitet<\/strong> dhe Risk n\u00eb Ndryshime t\u00eb Kontrat\u00ebs pas N\u00ebnshkrimit Fillestar.
