On 22 March 2021, the Council of Ministers issued Normative Act No. 9, approving the text of the Agreement between the Albanian State: Ministry of Health and Social Protection; Ministry of State for Reconstruction and Public Health Institute and the Authorized Distributor, the Turkish company Keymen Ilaç Sanayi Ve Ticaret A.Ş.
Scope of Agreement: Provide the Republic of Albania with the Vaccine against Covid-19 (Vero Cell) Inactivated Coronavac, created by Sinovac Life Science Co Ltd. and produced in the People’s Republic of China.
Article 3 of the Normative Act requires the Institutions and Parties not to publish the text of the agreement and its financial effects. Secret Confidential Agreement. According to a report published on the website of the Assembly of Albania attached to the Normative Act, the Committee of Experts for Immunization (an advisory body of the Minister of Health) examined the vaccine inactivated against Covid-19, Coronavac, created by Sinovac Life Science, Beijing, China.
The Committee concluded they were in favour of this vaccine. In their report, they say: The results of the first and second phase of this vaccine in China are published on the Lancet magazine, on 17 November 2020. This vaccine has already started the third phase trials in July 2020 in China, and later in Brazil, Turkey, Indonesia, and Chili. The third phase trials made in Brazil and Turkey assessed the vaccine efficiency on health employees offering treatment to COVID-19 patients. Currently, CoronaVac is approved for emergency use in China by the Regulatory Authority (Administration of national medical products), and approved for use in Azerbaijan, Bolivia, Brazil, Dominican Republic, Ecuador, Hong Kong, Indonesia, Laos, Mexico, Paraguay, Philippine, Thailand, Tunisia, Turkey, Ukraine, and Uruguay, etc. This vaccine is also used in EU Member states like Hungary.
The Council of Ministers approved the Normative Act No. 10, dated 24.03.2021 “Agreement between the parties”.
Financial Effects
This normative act has financial effects, which shall be covered by the state budget reserve fund.
The Law on the State Budget is amended three times from its approval until April 2021. The Normative Act No. 8, dated 22.3.2021 – the Reserve Fund is estimated to be about 5 billion leke (It was 4 billion according to the State Budget Law of 2021, so it is increased by 1 billion).
The purpose of the approval of this normative act is to secure the necessary funds through changes to the budgetary expenses. i.e. a reallocation between two elements of the reserve fund for purchasing the vaccine from the Turkish company “Keymen Ila9 Sanayi ve Ticaret”, A.S. created by Sinovac Life Science Co, Ltd. And produced in the People’s Republic of China. The total amount is 10 000 000 (ten million) USD, converted into leke by the official exchange rate on the date of payment, it is about 1.1 billion leke.
The Public Health Institute is the institution that will pay for the vaccine doses.
The normative act makes only one change to the budgetary expenses, a reallocation between two elements of the reserve fund, namely:
- 10 million USD, the Albanian Government approves the First Payment to the Turkish Distributor of Sinovax, produced in the People’s Republic of China.
By Decision of the Council of Ministers No. 174/2021, it was decided that the Institute of Public Health shall make a payment of 10 million USD (ten million American dollars) in favour of theauthorized distributor “Keymen Ilaç Sanayi ve ticaret” A.S., for supplying the Republic of Albania with the vaccine against COVID-19 (vero cell) inactivated, Coronavac, created by Sinovac Life Science Co, Ltd. And produced in the People’s Republic of China (point 1 of the decision). Point 2 of the decision provides that the ministry of Health and Social Protection is allocated the equivalent amount in Albanian lekë (as per the official exchange rate on the date of payment) of the 10 million USD in its budget approved for 2021, respectively to the Institute of Public Health, the economic account 6050000 (Product 91305AH) of the public health program (07450). This fund, according to pint 2 of this decision shall be covered by the reserve fund of the state budget, approved for 2021.
In its first parliamentary session following the suspension of work because of the electoral campaign, on May 4th, the Assembly’s agenda included the Consent to be reached on the two Normative Acts related with additional purchases of anti-Covid vaccines and their financial effects.
- The Turkish Distributor announces it can not supply Chinese-made and packaged vaccines.
Through Normative Act No. 14, dated 7.4.2021 – On changes and additions to Normative Act No. 9, dated 22.03.2021, the title and scope of the Agreement between the Parties is amended.
The accompanying report clarifies that the distribution company has announced that the Chinese Sonovac Life Sciences has stopped providing supplies of its product CoronaVac Covid 19 – Vero Cell as a product that is no longer available. After that, a Turkish company (distributor) has received supplies of Coronavac 600SU/IM- Suspension for injection packaged in puncture bottles of 0,5 ml, which contains the active substance, the inactivated viral antigen ‘Sars-CoV-2’, developed by SinoVac Life Science Co., Ltd., produced in the People’s Republic of China, and packaged in the Republic of Turkey by Keymen. Therefore, the Albanian party is proposed to continue getting Turkish-packaged supplies.
- Changes made to the Purchase Agreement, the Albanian State agrees to the Chinese vaccines packaged in Turkey Coronavac 600SU/IM- Suspension.
The Albanian party, after consultations with the Technical Committee of Immunization (meeting of 6 April 2021), decided to consider the same effects and agree to the proposal of the contracting party.
- 14 April 2021, the Government allocates an additional 2 billion Albanian lek to the State Budget for the Reserve Fund for Covid-19 related Vaccines and Situation.
Regarding its financial effects, a Consent is also to be reached on the Normative Act No. 18, dated 14.4.2021 on the first working day of the Assembly after the elections. Through this Act, the State Budget Reserve Fund is increased from 5 billion to 7 billion Albanian leke, i.e. an additional amount of 2 billion Albanian lekë, for covering the purchase of vaccines during 2021, including also any other eventual expenses of the Government related with the COVID-19 pandemic. The Albanian party has received information from formal exchanges with the Turkish Health Ministry about this vaccine being used in the Republic of Turkey.

Shoqëria ka fituar 31 tendera gjatë situatës Covid -19 me 13 institucione shëndetësore. Ndërsa në total në sektorin shëndetësi duke fituar e vetme pa bashkime me operator të tjerë, ajo ka (deri maj 2021) 111 kontrata.
Në vend të dytë është shoqëria EVITA shpk. Kjo shoqëri ka fituar tendera në vlerën 627.5 milion Lekë. Shoqëria është kontraktuar për 4 raste në blerje të Kite, Reagent dhe Teste Diagnostikuese.
Intermed ne vendin e tretë është kontraktuar në blerjen e artikujve për masa mbrojtëse. Vlera e kontratave të fituara prej saj është 384.5 milion Lekë.
Një tjetër renditje interesante është edhe ajo e Kontraktorëve për materiale dhe shërbime shëndetësore sipas Pagesave të përfituara deri në Maj 2021 përmes Transaksione Thesari. Kjo tregon edhe ecurinë e kontratave të fituara të cilat kanë dinamikë të ndryshme në dorëzime mallrash, pranim situacionesh dhe pagesë e kundravlerës. Denouncement made to the State Election Commissioner over the Reconstruction Fund being used in Durrës for favoring Electoral Subject
/in Events, Homeposts, Press Releases /by adminAIS reported to the Election Commissioner on Misuse of Public Money during Elections through Individual Grants from the Reconstruction Fund in the electoral zone of Durrës following the November 2019 earthquake. Such misuse went in favor of the party in power at the central and local levels, running in these elections. Sixteen months after the earthquake, Unconditional Transfers were allocated to Durrës municipality during the Electoral Campaign through a Decisions of the Council of Ministers, without a law, in the amount of 946.44 million Lek. Again, on electoral dates, the local government in Durrës has approved the lists of new beneficiaries, not previously identified. The week before the 25th of April, the Municipality has paid three times more money than every other month after the earthquake. The Reconstruction Ministry has delayed the benefits for 16 months after the earthquake and has not undertaken any legal action to guarantee that the Fund is not misused by paying individuals not eligible for the economic benefit, whose affected property is luxurious or a secondary house, i.e. wealthy properties. The Commissioner is asked to undertake an administrative investigation, check facts, and use independent international expertise over the use of public funds in the Electoral Campaign. Finally, the Commissioner is asked to assess the responsibilities for Electoral Favouring through Misuse of Public Money (Article 92/5 of the Code).

AIS denounces the Municipality of Tirana for Lack of Transparency over Beneficiaries of the Reconstruction Fund during the Electoral Campaign
/in Events, Homeposts, Press Releases /by adminThe Non-Governmental Organization, AIS/Open Data Albania, addressed today, date 25.05.2021 the Commissioner for the Right to Information, complaining about the Municipality of Tirana. The complaint against this municipality follows the latter’s refusal to publish the decisions of the Municipality Council on the “List of names of beneficiaries from the Reconstruction Fund” for the dates corresponding with the 2021 electoral campaign.
AIS addressed the Municipality on 6 May 2021, requesting access to the decisions of the Municipality Council of Tirana, on the Full List of Beneficiaries of the Reconstruction Fund for Tirana.
The requested documents were not published on the Municipality website, under the “Decisions of Tirana Municipality Council” section.
On 18 May, the Coordinator for Information of Tirana Municipality refused to meet our request submitted by letter no. A-9928/2 Prot., arguing as follows: We may not provide you with the names of the beneficiaries of these funds, because the lists attached as annexes to the Municipality Council Decisions contain personal data of the beneficiaries, such as ID numbers, information about their economic benefits, etc., which are protected by Law No. 9887, dated 10.03.2008 „On protection of personal data“.
According to AIS, promoter of Transparency and Accountability, the refusal of Tirana Municipality is not based on the law, it hinders accountability and transparency about public money and taxpayers’ money. The European law, national legislation, and practice require the principle of proportionality to be considered in disclosing the identity of the beneficiaries of the public grants. The European Court of Human Rights has issued a decision in favor of disclosure as an opportunity for citizens’ participation in the process of learning and assessing how their taxes are spent.
Therefore, the organization reacted by Complaining against the Municipality of Tirana, asking the Commissioner to order the Municipality to ensure Transparency over the Beneficiaries of the Reconstruction Grant during dates of the Electoral Campaign.
The Lists of Beneficiaries are approved by the Municipality of Tirana Council and grants are issued on dates within the Electoral Campaign for the 25 April 2021 Parliamentary Elections. Transparency and citizens- information is related to the need to verify potential doubts of misuse of public money during electoral campaigns for electoral purposes.
Therefore, the organization addressed the Commissioner, asking him to order the Municipality of Tirana to publish the full decisions on the beneficiaries of Albanian taxpayers’ money through the Reconstruction Fund Grants on 2021 electoral dates.
By this act, the Municipality is applying a double standard, affecting transparency only for the beneficiaries during the 2021 Electoral Campaign, as it was the Municipality itself, which has already published the Nominal Lists ( Illustrative Video and PDF ) of the Families in 2019 and 2020.

Electoral Campaign Period and Reconstruction Fund, Additional Budget as Unconditional Transfer to 11 Municipalities

The focus is on the transfers adopted by Decisions of the Council of Ministers (DCM) during the Electoral Campaign Period, 25 March to 25 April 2021. The analysis looks also at the pre-electoral dates, from January 1 to April 25.

Municipality of Tirana. Was allocated through Decisions of the Council of Ministers, Unconditional Transfers on Electoral Dates (30 days of the campaign) amounting to 6 055 001 800 ALL (six billion and fifty-five million and one thousand Eighty ALL). These transfers are ordered by DCM No.189 of 25 March; DCM No.202 of 25 March; DCM No.204 of 25 March.
Municipality of Durres. Was allocated additional Unconditional Transfers by Decision of the Council of Ministers during the Electoral Period amounting to 1 181 590 365 ALL (one billion one hundred and eighty-one million five hundred and ninety thousand three hundred and sixty-five ALL). DCM No.189 of 25 March; DCM No. 201 of 25 March; DCM No.205 of 24 March and DCM no 213 of 31 March.
Municipality of Kamëz By Decisions of the Council of Ministers, this municipality has benefitted 227 909 231 Lek (two hundred twenty-seven thousand nine hundred and nine thousand two hundred and thirty-one ALL. DCM No. 200 dated March 25; DCM No.201 dated March 31; DCM No.211 dated March 31, and DCM No.235 dated April 14.
Municipality of Kurbin. By Decisions of the Council of Ministers benefited Lek 529 262 087 (Five hundred twenty-nine million two hundred sixty-two thousand eighty-seven ALL. By DCM No. 215 dated 31 March; DCM No. 233 dated 14 April and Decision 234 dated 14 April.
Municipality of Shijak Has benefited 143 662 566 ALL in the Electoral Period. DCM No. 212 dated March 31 was taken during this period.
Municipality of Vora. By decision of the Council of Ministers it benefited 175 148 070 ALL (one hundred and seventy-five million and one hundred and forty-eight thousand and seventy ALL). Decision of the Council of Ministers No. 189 dated March 25; DCM No. 236 dated April 14 and DCM No. 237 dated April 14.
Municipality of Kavaja. During the election period, this municipality benefited Unconditional Transfers in the amount of 201 959 863 ALL (two hundred and one million nine hundred and fifty-nine million eight hundred and six seventy-three ALL). This was done through DCM No.206 dated March 25 and DCM No.205 dated March 25.
Mirdita Municipality received 42 262 535 ALL (forty-two million two hundred sixty-two thousand five hundred thirty-five ALL. By DCM No.200 dated March 25; and DCM No.233 dated April 14.
Rrogozhina Municipality and Kruja Municipality did not receive funds on election dates. DCMs for Unconditional Transfers from the Reconstruction Fund were taken at earlier dates
Municipality of Lezha. This municipality has benefited by Decision of the Council of Ministers transfers amounting to 17 835 093 Lek (seventeen million eight hundred thirty-five thousand ninety-three ALL. DCM No.215 Date March 31, 2021.
Typical Unconditional Transfers are funds from the State Budget for Municipalities for guaranteeing some basic services of the Local Government such as basic education, social protection, management of forests, roads, waters, etc. The unconditional transfer is determined through a formula every year and is adopted as a separate table and item of the Law on State Budget. If we compare certain additional transfers allocated in December 2020 with the additional funds received by Municipalities as Unconditional Transfers from the Reconstruction Fund through DCMs before elections and DCMs taken on election dates, we see a concentration on the dates which the Electoral Code recognizes as the electoral campaign dates.

According to a report published on the website of the Assembly of Albania attached to the Normative Act, the Committee of Experts for Immunization (an advisory body of the Minister of Health) examined the vaccine inactivated against Covid-19, Coronavac, created by Sinovac Life Science, Beijing, China.
The Committee concluded they were in favour of this vaccine. In their report, they say: The results of the first and second phase of this vaccine in China are published on the Lancet magazine, on 17 November 2020. This vaccine has already started the third phase trials in July 2020 in China, and later in Brazil, Turkey, Indonesia, and Chili. The third phase trials made in Brazil and Turkey assessed the vaccine efficiency on health employees offering treatment to COVID-19 patients. Currently, CoronaVac is approved for emergency use in China by the Regulatory Authority (Administration of national medical products), and approved for use in Azerbaijan, Bolivia, Brazil, Dominican Republic, Ecuador, Hong Kong, Indonesia, Laos, Mexico, Paraguay, Philippine, Thailand, Tunisia, Turkey, Ukraine, and Uruguay, etc. This vaccine is also used in EU Member states like Hungary.
The Council of Ministers approved the Normative Act No. 10, dated 24.03.2021 “Agreement between the parties”.
Financial Effects
This normative act has financial effects, which shall be covered by the state budget reserve fund.
The Law on the State Budget is amended three times from its approval until April 2021. The Normative Act No. 8, dated 22.3.2021 – the Reserve Fund is estimated to be about 5 billion leke (It was 4 billion according to the State Budget Law of 2021, so it is increased by 1 billion).
The purpose of the approval of this normative act is to secure the necessary funds through changes to the budgetary expenses. i.e. a reallocation between two elements of the reserve fund for purchasing the vaccine from the Turkish company “Keymen Ila9 Sanayi ve Ticaret”, A.S. created by Sinovac Life Science Co, Ltd. And produced in the People’s Republic of China. The total amount is 10 000 000 (ten million) USD, converted into leke by the official exchange rate on the date of payment, it is about 1.1 billion leke.
The Public Health Institute is the institution that will pay for the vaccine doses.
The normative act makes only one change to the budgetary expenses, a reallocation between two elements of the reserve fund, namely:
By Decision of the Council of Ministers No. 174/2021, it was decided that the Institute of Public Health shall make a payment of 10 million USD (ten million American dollars) in favour of theauthorized distributor “Keymen Ilaç Sanayi ve ticaret” A.S., for supplying the Republic of Albania with the vaccine against COVID-19 (vero cell) inactivated, Coronavac, created by Sinovac Life Science Co, Ltd. And produced in the People’s Republic of China (point 1 of the decision). Point 2 of the decision provides that the ministry of Health and Social Protection is allocated the equivalent amount in Albanian lekë (as per the official exchange rate on the date of payment) of the 10 million USD in its budget approved for 2021, respectively to the Institute of Public Health, the economic account 6050000 (Product 91305AH) of the public health program (07450). This fund, according to pint 2 of this decision shall be covered by the reserve fund of the state budget, approved for 2021.
In its first parliamentary session following the suspension of work because of the electoral campaign, on May 4th, the Assembly’s agenda included the Consent to be reached on the two Normative Acts related with additional purchases of anti-Covid vaccines and their financial effects.
Through Normative Act No. 14, dated 7.4.2021 – On changes and additions to Normative Act No. 9, dated 22.03.2021, the title and scope of the Agreement between the Parties is amended.
The accompanying report clarifies that the distribution company has announced that the Chinese Sonovac Life Sciences has stopped providing supplies of its product CoronaVac Covid 19 – Vero Cell as a product that is no longer available. After that, a Turkish company (distributor) has received supplies of Coronavac 600SU/IM- Suspension for injection packaged in puncture bottles of 0,5 ml, which contains the active substance, the inactivated viral antigen ‘Sars-CoV-2’, developed by SinoVac Life Science Co., Ltd., produced in the People’s Republic of China, and packaged in the Republic of Turkey by Keymen. Therefore, the Albanian party is proposed to continue getting Turkish-packaged supplies.
The Albanian party, after consultations with the Technical Committee of Immunization (meeting of 6 April 2021), decided to consider the same effects and agree to the proposal of the contracting party.
Regarding its financial effects, a Consent is also to be reached on the Normative Act No. 18, dated 14.4.2021 on the first working day of the Assembly after the elections. Through this Act, the State Budget Reserve Fund is increased from 5 billion to 7 billion Albanian leke, i.e. an additional amount of 2 billion Albanian lekë, for covering the purchase of vaccines during 2021, including also any other eventual expenses of the Government related with the COVID-19 pandemic. The Albanian party has received information from formal exchanges with the Turkish Health Ministry about this vaccine being used in the Republic of Turkey.
Data on contracts signed in relation to Covid-19 are published in the framework of AIS Project on Contracting in a State of Natural Disaster Covid19 – Strengthening Independent Monitoring Mechanisms.All the contracts signed by the Albanian State for Supplies related with Covid-19 are available on the Open Procurement Albania database.
