Ndiq Paratë Ndarja Sektoriale Koncesione dhe PPP të miratuara 2017 – 2020

Open Data Albania po hulumton mbi Ndarjen Sektoriale për koncesione dhe Partneritetit Publik Privat PPP të miratuara në Shqipëri gjatë periudhës Janar 2017 – Dhjetor 2020. Artikulli identifikon numrin dhe vlerën e investimit specifikuar Sektorin Institucional dhe Kategorinë Sektoriale. Të dhënat janë nga databaza e Regjistrit Koncesionar PPP të publikuar në portalin OpenCorporates.al.

  • Gjatë periudhës Janar 2017 deri në Dhjetor 2020, në Shqipëri janë miratuar 24 kontrata koncesioni apo PPP me vlerë totale Investimi prej 125 199 058 469 Lekë (125.19 Miliard Lekë), ose konvertuar në Euro 1 009 669 826 Euro (1 miliard Euro).

  • Si Sektor Institucional ku janë aplikuar Koncesione PPP gjatë kësaj periudhe listohet Energjetika, Transporti, Mjedisi, Zhvillimi Urban, Shëndetësi dhe Kontroll Fiskal.

  • Sektori Institucional Energjetike shënon numrin më të madh të kontratave. Sektori Institucional Transport ka vlerën më të lartë të Investimeve në PPP dhe Koncesione.

Kategoritë Sektoriale (te ndryshme nga Institucionale) që janë aplikuar gjatë katër vjecarit janë Menaxhim Mbetje; Infrastrukturë Rrugore; Infrastrukturë Detare Porte; Infrastrukturë Aeroporte; Hidro Energjetikë; Arsim; Shëndetësi; Kontroll Fiskal dhe Shërbime.

  • Kategoria sektoriale Infrastrukturë Rrugore janë miratuar tre Koncesione PPP me vlerë Investimi 62 115 823 913 Lekë. Konkretisht me kompaninë koncesionare Gjoka 87 sh.p.k zbatuese e kontratës Koncesion PPP  për Përmirësimin Ndërtimin Operimin dhe Mirëmbajtjen e Rrugës së Arbrit; kompania Bardh Konstruksion për Projektimin, Ndërtimin dhe Mirëmbajtjen e segmentit rrugës Milot Balldre si dhe kompania Rruga Orikum Llogara sh.p.k zbatuese e kontratës për Projektimin, Ndërtimin dhe Mirëmbajtjen e segmentit e rrugës Porti i Jahteve-Bypass Orikum Dukat, Ura e Shën Elizës.

  • Kategorinë Infrastrukturë Porte Detare është miratuar një Kontratë Koncesioni me vlerë Investimi 1 374 984 000  Lekë, konkretisht Kontrata Koncesion PPP të Portit turistik dhe shërbimeve Marina Limion me kompaninë Marina Limion sh.a.

  • Kategoria sektoriale Infrastrukturë Aeroporte është miratuar Kontrata e Koncesionit PPP për Rehabilitimin Operimin Transferimin e Aeroportit të Kukësit nga shoqëria koncesionare Kukës International Airport sh.p.k.

  • Për Shërbime është miratuar kontrata Për dhënien me koncesion të disa shërbimeve Detare me kompaninë Anijet e Shërbimit Detar sh.a

  • Menaxhimit të Mbetjeve (Waste Management), që përfshin grumbullimin, transportin, rikuperimin, asgjësimin e mbetjeve dhe prodhimin e energjisë janë miratuar dy kontrata koncesioni PPP me vlerë 18 471 152 055  Lekë, e konvertuar rreth 148 960 904 Euro që përbën rreth 14.8% e vlerës totale të investimit për gjithë Koncesione PPP  të miratuara në këtë periudhë. Në këtë sektor përfshihet kontrata Për Ndërtimin e Landfillit, Inceneratorit dhe rehabilitimin e Venddepozitimeve ekzistuese,Tiranë, me shoqëri koncesionare Integrated Energy BV SPV  dhe kontrata Për dhënien me koncesion të shërbimit të pastrimit, grumbullimit, transportimit dhe seleksionimit të mbetjeve urbane për Qytetin Kamzë me shoqëri zbatuese Eco Cleaning sh.p.k

  • Sektorit të Zhvillimit Urban shënon dy koncesione me vlerë totale të investimit 4 102 552 269 Lekë rreth 33 085 099  Euro. Zhvillimet janë në kategorinë sektoriale Arsim dhe bëhet fjalë Për përmirësimin e infrastrukturës Arsimore në Bashkinë Tiranë, zona Tirana 1 me shoqëri koncesionare Z.M.A sh.p.k  dhe Për përmirësimin e infrastrukturës Arsimore në Bashkinë e Tiranës për katër objektet arsimore në zonën Tirana 4 sh.p.k.

  • Gjatë periudhës të marrë në shqyrtim Në sektorin e Shëndetësisë është lidhur një Partneritet Publik Privat Për ofrimin e shërbimit laboratorik të spitaleve universitare, rajonale dhe atyre bashkiake, me kompani koncesionare zbatuese Laboratory Networks sh.p.k.

  • Gjithashtu gjatë kësaj periudhe është miratuar një kontratë në sektorin e Kontrollit Fiskal, konkretisht Partneriteti Publik Privat Shërbimi i kontrollit ligjor të instrumenteve matës, nëpërmjet instrumenteve shpërndarës të karburantit dhe gazit të lëngshëm, shoqëri koncesionare Noa Inspect sh.p.k

Biznese Kontraktore Shëndetësi Covid-19, Mars 2020 – Maj 2021

AIS organizatë promotore e Open Data Albania po hulumton mbi Biznese, kontraktorë në sektorin shëndetësi, për blerje për përballim të Situatës Covid-19. Hulumtimi është bërë për Kontrata ku janë njoftuar fitues, sikurse për Pagesa Thesari të ekzekutuara në favor të tyre në datat mars 2020 deri maj 2021. Kompanitë janë listuar sipas totalit të vlerës. Në këtë listim nuk bëjnë pjesë kontratat apo marrëveshjet ku nuk ka vlerë totale por ka vetëm çmim për njësi.

Gjithashtu fitues të Kontratave për Nevoja Thelbësore të Shtetit janë listuar në një artikull tjetër. Në këto kontrata procedura nuk është e hapur dhe e aksesueshme, informacioni mbi vlerat dhe objektin jepet pjesërisht për shkak të mungesës së njoftimeve publike si kontrata sekrete.

Po njësoj nuk do listojmë edhe Kompanitë që janë kontraktuar për Blerje Vaksine, Biznese apo Subjekte të huaja për kontrata kryesisht Sekrete. Për këtë kategori Blerjesh është formuluar një artikull i veçantë.

Në Renditje sipas Vlerës së Kontratës së Fituar në Shëndetësi, për kontraktim blerje, investim apo porosi për Covid 19, Mars 2020 – Maj 2021, Biznesi i parë më i kontraktuar në vlerë është shoqëria GTS-Gazra Teknike Shqiptare shpk. Pasohet në renditje nga Evita shpk, Intermed shpk, Intermed shpk, Biometric Albania shpk, Messer AlbaGaz shpk, Euromed shpk ne bashkëpunim me Farma Net Albania, OES Distrimed shpk, Euromed shpk, Eurovia shpk. Farma Net Albania.

 

Kompania e parë në renditje sa i takon vlerë në tendera të situatës Covid-19 sektori shëndetësi është GTS-Gazra Teknike Shqiptare shpk. Ajo ka fituar tendera me vlerë totale pa tatim mbi vlerën e shtuar prej 2.08 miliard Lekë. Shoqëria zotërohet nga Italiania SOL spa. Tenderat ku ajo ka rezultuar operator i kontraktuar janë për furnizime dhe infrastrukturë Oksigjen mjekësor i gaztë. Shoqëria ka fituar 31 tendera gjatë situatës Covid -19 me 13 institucione shëndetësore. Ndërsa në total në sektorin shëndetësi duke fituar e vetme pa bashkime me operator të tjerë, ajo ka (deri maj 2021) 111 kontrata.

Në vend të dytë është shoqëria EVITA shpk. Kjo shoqëri ka fituar tendera në vlerën 627.5 milion Lekë. Shoqëria është kontraktuar për 4 raste në blerje të Kite, Reagent dhe Teste Diagnostikuese.

Intermed ne vendin e tretë është kontraktuar në blerjen e artikujve për masa mbrojtëse. Vlera e kontratave të fituara prej saj është 384.5 milion Lekë.

Një tjetër renditje interesante është edhe ajo e Kontraktorëve për materiale dhe shërbime shëndetësore sipas Pagesave të përfituara deri në Maj 2021 përmes Transaksione Thesari. Kjo tregon edhe ecurinë e kontratave të fituara të cilat kanë dinamikë të ndryshme në dorëzime mallrash, pranim situacionesh dhe pagesë e kundravlerës. Renditja sipas Transaksioneve të Thesarit të përfituara për Blerje Covid 19, Mars 2020 – Maj 2021.

Dhjetë shoqëritë vendase me pagesë më të lartë janë si vijon: GTS-Gazra Teknike Shqiptare shpk me 1 miliard lekë, Evita shpk me pagesa thesari për periudhën në vlerën 281.1 milion lekë, Euromed shpk me pagesa në vlerën 137.46 milion lekë. Renditja vijon me Biometric Albania, Eurovia, Messer Albagaz shpk, Gen- Alb Farma shpk, Intermed shpk, OES Distrimed.

Tendera Sektori Shëndetësi janë të publikuara në një format të mirëstrukturuar dhe analitik në faqen për Open Procurement Albania Shëndetësi. Po aty është krijuar një databazë analitike për tenderime dhe kontraktime të realizuara në funksion të nevojave të sektorit shëndetësi për përballimin e situatës Covid-19. Struktura dhe listimi i Informacionit janë sipas kategorive Blerje Oksigjen , Blerje Dizifektues, Mjete Mbrojtëse, Test Tampon , Barna , Aparatura , Kontraktime Vaksinimi , Kontraktime Sekrete sipas VKM Nr 203 datë 2020 , Të Tjera.

Ky artikull u realizua si pjesë e aktiviteteve në zbatim të projektit  Kontrata Publike në gjendje të Katastrofës Natyrore Covid 19 Forcimi i Mekanizmave të Pavarur të Monitorimit” projekt që përfundon në qershor 2021.

 

Denouncement made to the State Election Commissioner over the Reconstruction Fund being used in Durrës for favoring Electoral Subject

AIS reported to the Election Commissioner on Misuse of Public Money during Elections through Individual Grants from the Reconstruction Fund in the electoral zone of Durrës following the November 2019 earthquake. Such misuse went in favor of the party in power at the central and local levels, running in these elections. Sixteen months after the earthquake, Unconditional Transfers were allocated to Durrës municipality during the Electoral Campaign through a Decisions of the Council of Ministers, without a law, in the amount of 946.44 million Lek. Again, on electoral dates, the local government in Durrës has approved the lists of new beneficiaries, not previously identified. The week before the 25th of April, the Municipality has paid three times more money than every other month after the earthquake. The Reconstruction Ministry has delayed the benefits for 16 months after the earthquake and has not undertaken any legal action to guarantee that the Fund is not misused by paying individuals not eligible for the economic benefit, whose affected property is luxurious or a secondary house, i.e. wealthy properties. The Commissioner is asked to undertake an administrative investigation, check facts, and use independent international expertise over the use of public funds in the Electoral Campaign. Finally, the Commissioner is asked to assess the responsibilities for Electoral Favouring through Misuse of Public Money (Article 92/5 of the Code).

AIS denounces the Municipality of Tirana for Lack of Transparency over Beneficiaries of the Reconstruction Fund during the Electoral Campaign

The Non-Governmental Organization, AIS/Open Data Albania, addressed today, date 25.05.2021 the Commissioner for the Right to Information, complaining about the Municipality of Tirana. The complaint against this municipality follows the latter’s refusal to publish the decisions of the Municipality Council on the “List of names of beneficiaries from the Reconstruction Fund” for the dates corresponding with the 2021 electoral campaign.

AIS addressed the Municipality on 6 May 2021, requesting access to the decisions of the Municipality Council of Tirana, on the Full List of Beneficiaries of the Reconstruction Fund for Tirana.

The requested documents were not published on the Municipality website, under the “Decisions of Tirana Municipality Council” section.

On 18 May, the Coordinator for Information of Tirana Municipality refused to meet our request submitted by letter no. A-9928/2 Prot., arguing as follows: We may not provide you with the names of the beneficiaries of these funds, because the lists attached as annexes to the Municipality Council Decisions contain personal data of the beneficiaries, such as ID numbers, information about their economic benefits, etc., which are protected by Law No. 9887, dated 10.03.2008 „On protection of personal data“.

According to AIS, promoter of Transparency and Accountability, the refusal of Tirana Municipality is not based on the law, it hinders accountability and transparency about public money and taxpayers’ money. The European law, national legislation, and practice require the principle of proportionality to be considered in disclosing the identity of the beneficiaries of the public grants. The European Court of Human Rights has issued a decision in favor of disclosure as an opportunity for citizens’ participation in the process of learning and assessing how their taxes are spent.

Therefore, the organization reacted by Complaining against the Municipality of Tirana, asking the Commissioner to order the Municipality to ensure Transparency over the Beneficiaries of the Reconstruction Grant during dates of the Electoral Campaign.

The Lists of Beneficiaries are approved by the Municipality of Tirana Council and grants are issued on dates within the Electoral Campaign for the 25 April 2021 Parliamentary Elections. Transparency and citizens- information is related to the need to verify potential doubts of misuse of public money during electoral campaigns for electoral purposes.

Therefore, the organization addressed the Commissioner, asking him to order the Municipality of Tirana to publish the full decisions on the beneficiaries of Albanian taxpayers’ money through the Reconstruction Fund Grants on 2021 electoral dates.

By this act, the Municipality is applying a double standard, affecting transparency only for the beneficiaries during the 2021 Electoral Campaign, as it was the Municipality itself, which has already published the Nominal Lists ( Illustrative Video and PDF ) of the Families in 2019 and 2020.

Electoral Campaign Period and Reconstruction Fund, Additional Budget as Unconditional Transfer to 11 Municipalities

Open Data Albania has researched additional Unconditional Transfers for eleven municipalities benefiting from the Reconstruction Fund.  The focus is on the transfers adopted by Decisions of the Council of Ministers (DCM) during the Electoral Campaign Period, 25 March to 25 April 2021. The analysis looks also at the pre-electoral dates, from January 1 to April 25.

  • The budget transfer for eleven municipalities from the Reconstruction Fund for the period 1 January to 25 April 2021 is 15 430 836 420 Lek (fifteen billion four hundred thirty million eight hundred and thirty-six thousand four hundred and twenty ALL). In Euro, it is about 124.44 Million Euro.
  • Only on 30 Electoral Campaign Dates, this Unconditional Transfer to municipalities affected by the earthquake marked 8 574 636 507 Lek (eight billion five hundred seventy-four million six hundred and six hundred thirty-six thousand five hundred and seven ALL). In Euro, it is about 69.1 Million Euro.
  • In the first four months, the Albanian Government spent from the Reconstruction Fund transferring to municipalities as Unconditional Transfers 56% of the total Annual Reconstruction Fund. A significant part of the transfers went directly to Individual beneficiaries.
  • In 2020, the Albanian Government was criticized by the International Monetary Fund (IMF ) because of the failure to implement this Fund, the Reconstruction Program.
  • In the Law on the State Budget at the beginning of the year, in total, the  Unconditional transfers for these 11 Municipalities were 8 299 271 265 ALL. For the same 11 municipalities, the additional Unconditional Transfers through DCMs in the four months before the elections amounted to 15 430 836 420 ALL. The increase is 186 percent.
  • The municipalities of Tirana; Durres; Kurbin and Kamez have the highest increase. Compared with the Unconditional Transfers provided for in the Law at the Beginning of the Year, records were set by municipalities: Vora (549%); Kurbin (340%); Tirana (250%); Shijaku (228%).

Municipality of Tirana. Was allocated through Decisions of the Council of Ministers, Unconditional Transfers on Electoral Dates (30 days of the campaign) amounting to 6 055 001 800 ALL (six billion and fifty-five million and one thousand Eighty ALL). These transfers are ordered by DCM No.189 of 25 March; DCM No.202 of 25 March; DCM No.204 of 25 March.

Municipality of Durres. Was allocated additional Unconditional Transfers by Decision of the Council of Ministers during the Electoral Period amounting to 1 181 590 365 ALL (one billion one hundred and eighty-one million five hundred and ninety thousand three hundred and sixty-five ALL). DCM No.189 of 25 March; DCM No. 201 of 25 March; DCM No.205 of 24 March and DCM no 213 of 31 March.

Municipality of Kamëz  By Decisions of the Council of Ministers, this municipality has benefitted 227 909 231 Lek (two hundred twenty-seven thousand nine hundred and nine thousand two hundred and thirty-one ALL. DCM No. 200 dated March 25; DCM No.201 dated March 31; DCM No.211 dated March 31, and DCM No.235 dated April 14.

Municipality of Kurbin. By Decisions of the Council of Ministers benefited Lek 529 262 087 (Five hundred twenty-nine million two hundred sixty-two thousand eighty-seven ALL. By DCM No. 215 dated 31 March; DCM No. 233 dated 14 April and Decision 234 dated 14 April.

Municipality of Shijak Has benefited 143 662 566 ALL in the Electoral Period. DCM No. 212 dated March 31 was taken during this period.

Municipality of Vora. By decision of the Council of Ministers it benefited 175 148 070 ALL (one hundred and seventy-five million and one hundred and forty-eight thousand and seventy ALL). Decision of the Council of Ministers No. 189 dated March 25; DCM No. 236 dated April 14 and DCM No. 237 dated April 14.

Municipality of Kavaja. During the election period, this municipality benefited Unconditional Transfers in the amount of 201 959 863 ALL (two hundred and one million nine hundred and fifty-nine million eight hundred and six seventy-three ALL). This was done through DCM No.206 dated March 25 and DCM No.205 dated March 25.

Mirdita Municipality received 42 262 535 ALL (forty-two million two hundred sixty-two thousand five hundred thirty-five ALL. By DCM No.200 dated March 25; and DCM No.233 dated April 14.

Rrogozhina Municipality and Kruja Municipality did not receive funds on election dates. DCMs for Unconditional Transfers from the Reconstruction Fund were taken at earlier dates

Municipality of Lezha. This municipality has benefited by Decision of the Council of Ministers transfers amounting to 17 835 093 Lek (seventeen million eight hundred thirty-five thousand ninety-three ALL. DCM No.215 Date March 31, 2021.

Typical Unconditional Transfers are funds from the State Budget for Municipalities for guaranteeing some basic services of the Local Government such as basic education, social protection, management of forests, roads, waters, etc. The unconditional transfer is determined through a formula every year and is adopted as a separate table and item of the Law on State Budget. If we compare certain additional transfers allocated in December 2020 with the additional funds received by Municipalities as Unconditional Transfers from the Reconstruction Fund through DCMs before elections and DCMs taken on election dates, we see a concentration on the dates which the Electoral Code recognizes as the electoral campaign dates.

Lista Emërore me Përfitues nga Fonde Publike të Bashkisë Tiranë nuk është e aksesueshme për publikun. Megjithëse është pjesë e Informacioni dhe aneks VKB të kërkuara duhet të jenë publike, sa kohë që ato informojnë mbi shpërndarje të parave publike, para të taksapaguesve tek individ përfitues. Po njësoj rëndësia e Dokumentit për Akses Publik është e shtuar sa kohë që këto janë vendime të mara në periudha dhe data të parashikuara si data zgjedhore për Procesin Zgjedhor 25 Prill 2025.

On 22 March 2021, the Council of Ministers issued Normative Act No. 9, approving the text of the Agreement between the Albanian State: Ministry of Health and Social Protection; Ministry of State for Reconstruction and Public Health Institute and the Authorized Distributor, the Turkish company Keymen Ilaç Sanayi Ve Ticaret A.Ş.

Scope of Agreement: Provide the Republic of Albania with the Vaccine against Covid-19 (Vero Cell) Inactivated Coronavac, created by Sinovac Life Science Co Ltd. and produced in the People’s Republic of China.

Article 3 of the Normative Act requires the Institutions and Parties not to publish the text of the agreement and its financial effects. Secret Confidential Agreement. According to a report published on the website of the Assembly of Albania attached to the Normative Act, the Committee of Experts for Immunization (an advisory body of the Minister of Health) examined the vaccine inactivated against Covid-19, Coronavac, created by Sinovac Life Science, Beijing, China.

The Committee concluded they were in favour of this vaccine. In their report, they say: The results of the first and second phase of this vaccine in China are published on the Lancet magazine, on 17 November 2020. This vaccine has already started the third phase trials in July 2020 in China, and later in Brazil, Turkey, Indonesia, and Chili.  The third phase trials made in Brazil and Turkey assessed the vaccine efficiency on health employees offering treatment to COVID-19 patients. Currently, CoronaVac is approved for emergency use in China by the Regulatory Authority (Administration of national medical products), and approved for use in Azerbaijan, Bolivia, Brazil, Dominican Republic, Ecuador, Hong Kong, Indonesia, Laos, Mexico, Paraguay, Philippine, Thailand, Tunisia, Turkey, Ukraine, and Uruguay, etc. This vaccine is also used in EU Member states like Hungary.
The Council of Ministers approved the Normative Act No. 10, dated 24.03.2021 “Agreement between the parties”.

Financial Effects

This normative act has financial effects, which shall be covered by the state budget reserve fund.

The Law on the State Budget is amended three times from its approval until April 2021. The Normative Act No. 8, dated 22.3.2021 – the Reserve Fund is estimated to be about 5 billion leke (It was 4 billion according to the State Budget Law of 2021, so it is increased by 1 billion).

The purpose of the approval of this normative act is to secure the necessary funds through changes to the budgetary expenses. i.e. a reallocation between two elements of the reserve fund for purchasing the vaccine from the Turkish company “Keymen Ila9 Sanayi ve Ticaret”, A.S. created by Sinovac Life Science Co, Ltd. And produced in the People’s Republic of China. The total amount is 10 000 000 (ten million) USD, converted into leke by the official exchange rate on the date of payment, it is about 1.1 billion leke.

The Public Health Institute is the institution that will pay for the vaccine doses.

The normative act makes only one change to the budgetary expenses, a reallocation between two elements of the reserve fund, namely:

  • 10 million USD, the Albanian Government approves the First Payment to the Turkish Distributor of Sinovax, produced in the People’s Republic of China.

By Decision of the Council of Ministers No. 174/2021, it was decided that the Institute of Public Health shall make a payment of 10 million USD (ten million American dollars) in favour of theauthorized distributor “Keymen Ilaç Sanayi ve ticaret” A.S., for supplying the Republic of Albania with the vaccine against COVID-19 (vero cell) inactivated, Coronavac, created by Sinovac Life Science Co, Ltd. And produced in the People’s Republic of China (point 1 of the decision). Point 2 of the decision provides that the ministry of Health and Social Protection is allocated the equivalent amount in Albanian lekë (as per the official exchange rate on the date of payment) of the 10 million USD in its budget approved for 2021, respectively to the Institute of Public Health, the economic account 6050000 (Product 91305AH) of the public health program (07450). This fund, according to pint 2 of this decision shall be covered by the reserve fund of the state budget, approved for 2021.

In its first parliamentary session following the suspension of work because of the electoral campaign, on May 4th, the Assembly’s agenda included the Consent to be reached on the two Normative Acts related with additional purchases of anti-Covid vaccines and their financial effects.

  • The Turkish Distributor announces it can not supply Chinese-made and packaged vaccines.

Through Normative Act No. 14, dated 7.4.2021 – On changes and additions to Normative Act No. 9, dated 22.03.2021, the title and scope of the Agreement between the Parties is amended.

The accompanying report clarifies that the distribution company has announced that the Chinese  Sonovac Life Sciences has stopped providing supplies of its product CoronaVac Covid 19 – Vero Cell  as a product that is no longer available. After that, a Turkish company (distributor) has received supplies of Coronavac 600SU/IM- Suspension for injection packaged in puncture bottles of 0,5 ml, which contains the active substance, the inactivated viral antigen ‘Sars-CoV-2’, developed by SinoVac Life Science Co., Ltd., produced in the People’s Republic of China, and packaged in the Republic of Turkey by Keymen. Therefore, the Albanian party is proposed to continue getting Turkish-packaged supplies.

  • Changes made to the Purchase Agreement, the Albanian State agrees to the Chinese vaccines packaged in Turkey Coronavac 600SU/IM- Suspension.

The Albanian party, after consultations with the Technical Committee of Immunization (meeting of 6 April 2021), decided to consider the same effects and agree to the proposal of the contracting party.

  • 14 April 2021, the Government allocates an additional 2 billion Albanian lek to the State Budget for the Reserve Fund for Covid-19 related Vaccines and Situation.

Regarding its financial effects, a Consent is also to be reached on the Normative Act No. 18, dated 14.4.2021 on the first working day of the Assembly after the elections. Through this Act, the State Budget Reserve Fund is increased from 5 billion to 7 billion Albanian leke, i.e. an additional amount of 2 billion Albanian lekë, for covering the purchase of vaccines during 2021, including also any other eventual expenses of the Government related with the COVID-19 pandemic. The Albanian party has received information from formal exchanges with the Turkish Health Ministry about this vaccine being used in the Republic of Turkey.

2021 Budget, Public Costs envisioned for Private Public Partnership (PPP) Concessions

Open Data Albania is investigating the costs envisioned to be paid for Private Public Partnerships (PPP) or concessions, covered by the 2021 state budget. The article conducts an analysis of the concessionary PPP contracts that are active in 2021 and the costs envisioned for each of these contracts for the period 2018-2023.

In 2021, according to the Explanatory Report of Law No. 137, the 16.12.2020 ‘On the 2021 Budget’, 18 PPP concessions are to be covered by public funds. Over 274 concessionary companies are registered in the country. For each of them, the Concessionary Register created by AIS organization contains information and data on the scope of the contract, its management, and performance. Of these concessionary PPP contracts, some are budgeted and paid directly from the state budget. The total value envisioned to support concessions from public funds for 2021 is a planned amount of 14 432 692 000 (fourteen billion and four hundred and thirty-two million and six hundred and ninety-two thousand ALL). If we convert it to Euros, it is equal to around 116 769 352 (one hundred and sixteen million and seven hundred and sixty-nine thousand and three hundred and fifty-two) Euros, according to the official average exchange rate of the Bank of Albania for 2020.

The planned cost for 2021 for covering these concessions by public funds is equal to fifteen point seventy-four (15.74%) per cent of the total investments envisioned in the 2021 budget.

In terms of the budget deficit, the value stands at thirteen points twenty-eight (13.28) per cent of the projected deficit value for 2021.

Also, the planned cost for covering PPP concessions by public funds expressed in terms of Gross Domestic Product results in zero point zero nine (0.09) per cent of the Gross Domestic Product.

The legal condition for calculating Costs for covering PPPs by public funds and state budget is that the total amount of annual net payments, which are conducted by the central government units, which result from the concessionary contracts or public private partnerships (PPP), should not exceed the limit of 5 per cent of the actual budget tax revenues of the previous year. For 2021, the costs planned for PPP concessionary contracts are estimated at three points twenty-six (3.26) per cent of tax revenues.

The highest cost among thirteen contracts envisioned for public funding for 2021, is marked by the contract for the construction and operation of “Rruga e Arbrit” (Arber Road). The projected value for this contract is 4 105 100 000 (four billion and one hundred and five million and one hundred thousand ALL, or 28% of the cost planned for the total PPP for 2021. This is the contract with the highest value, signed by the Ministry of Infrastructure and Energy. The contract is implemented by the concessionary company Gjoka 87. The contract is signed in 2018 with the company Gjoka Konstruksion. During the period 2019-2023, payments envisioned as budgetary support from public funds for the contract are estimated at 16 529 100 000 (sixteen billion and five hundred and twenty-nine million and one hundred thousand).

The second largest contract is the one entitled Concession/PPP (Provision of customized set of surgical instruments, sterile single-use medical supplies used in surgical halls, biological waste treatment and disinfection of surgical halls). The projected value in 2021 for this contract covered by public funds is 1 704 982 000 (one billion and seven hundred and four million and nine hundred and eighty thousand) ALL, or 12% of the planned total cost for 2021. This contract is signed by the Ministry of Health and Social Protection. This contract is managed by SaniService concessionary company and is signed with this company in 2015. During the period 2018-2023 payments envisioned as budgetary support covered by public funds are projected at 10 027 713 000 (ten billion and twenty-seven million and seven hundred and thirteen thousand) ALL.

The third largest contract ais entitled “Customs scanning service”. The projected value for this contract is 1 580 698 000 (one billion and five hundred and eighty million and six hundred and ninety-eight thousand) ALL or 11% of the planned total cost for 2021.  This contract is signed by the Ministry of Finances and Economy. This concessionary contract is managed by 2S Albania company. The contract is signed in 2013 with Rapiskan company, and is amended law in 2015. For the period 2018-2023 payments envisioned as budgetary support covered by public funds are estimated at 9 667 011 000 (nine billion and six hundred and sixty-seven million and eleven thousand) ALL.

The fourth contract in terms of the projected total cost is the one entitled “For the construction of the landfill, incinerator, and rehabilitation of existing Tirana waste disposal sites and electricity production. The projected value for this contract is 1 386 921 000 (one billion and  three hundred and eighty-six million and nine hundred and twenty-one thousand) ALL or 10% of the planned total cost for 2021.  This contract is signed by the Ministry of Infrastructure and Energy/Tirana Municipality. The contract is implemented by Integrated Energy BV SPV, owned by GeoGenix.  The contract is signed in 2017. For the period 2018-2023 payments envisioned as budgetary support covered by public funds for this concessionary project are estimated at 7 474 381 000 (seven billion and four hundred and seventy-four million and three hundred and eighty-one thousand) ALL.

Ranking continues with the PPP project for “Provision of Hospital Laboratory Services” The projected value for this contract is 1 280 444 000 (one billion and two hundred and eighty million and four hundred and forty-four thousand) ALL or 9 % of the planned total cost for 2021.  This contract is signed by the Ministry of Health and Social Protection. The concessionary contract is implemented by the laboratory NETWORKS company. http://opencorporates.al/sq/nuis/L91923002T The contract was signed in 2019 with a consortium consisting of a union of operators like Labopharma Sh.p.k & Exalab France & AB Laboratory Solutions B.V. For the period 2021-2023, payments envisioned as budgetary support for this contract, and covered by public funds are estimated at 6 923 565 000 (six billion and nine hundred and twenty-three million and five hundred and sixty-five thousand) ALL.

The concession/PPP for the medical checkup of the population aged 35-70 is planned to be paid during 2021 in an amount of 876 090 000 (eight hundred and seventy-six million and ninety thousand) ALL, or 6% of the planned total cost for 2021.  This contract is signed by the Ministry of Health and Social Protection. This concessionary contract is implemented by 3P Life Logistic. The contract is signed in 2015. For the period 2018-2023 payments envisioned as budgetary support covered by public funds are estimated at 5 256 523 000 (five billion and two hundred and fifty-six million and five hundred and twenty-three thousand) ALL.

Another concession contract that is active and covered with public funds is the one entitled “The construction, operation and maintenance of the Milot-Morine Road”. The projected value for this contract in 2021 is 800 259 000 (eight hundred million and two hundred and fifty-nine thousand) ALL, or 5.5% of the planned total cost for 2021.  This contract is signed by the Ministry of Infrastructure and Energy. This concessionary contract is managed by the concessionary company “ALBANIAN HIGHWAY CONCESSION”. The contract is signed in 2016 with the consortium ‘Catalyst Viva Das General Contracting LLC, Salillari, sh.p.k, Bee Tech-Violiap Ateve and Kastrati, sh.a’’. For the period 2019-2023, payments envisioned as budgetary support covered by public funds are estimated at 3 704 262 000 (three billion and seven hundred  and four million and two hundred and sixty-two thousand) ALL.

The next active contract in 2021 covered with public funds is the one entitled the Concession/PPP (Provision of the Dialysis Service in 5 regional hospitals). The projected value for this contract is 779 000 000 (seven hundred and seventy-nine million) ALL, or around 5.4% of the planned total cost for 2021.  This concessionary contract is managed by the concessionary company “DiaVita”. The contract is signed in 2016. For the period 2018-2023 payments envisioned as budgetary support covered by public funds are estimated at 4 475 539 000 (four billion and four hundred and seventy-five million and five hundred and thirty-nine thousand) ALL.

Another concessionary contract is the one entitles The construction, operation and transfer of the incinerator for processing of Fier urban waste. The projected value for this contract is 752 770 000 (seven hundred and fifty-two million seven hundred and seventy thousand) ALL, or about 5.2% of the planned total cost for 2021.  This concessionary contract is managed by the company Integrated TechnologyWaste Treatment Fier. The contract is signed in 2016. For the period 2018-2022, payments envisioned as budgetary support covered by public funds are estimated at 3 763 852 000 (three billion and seven hundred and seventy-three million and eight hundred and fifty-two thousand) ALL.

An active concession project in 2021 is the one entitled “For improving educational infrastructure in the municipality of Tirana. The projected value for this project is 658 325 000 (six hundred and fifty-eight million and three hundred and twenty-five thousand) ALL, or about 5% of the planned total cost for 2021. There are currently two contracts to improve educational infrastructure through PPP concessions (known as the concessionary schools). The contract for improving the educational infrastructure in Tirana Municipality in Zone is implemented by concessionary company Z.M.A. The contract is signed in 2018 with the winning group of operators, including: GI KONS shpk, MET ENGENEERING shpk and ZENTI&CO. This project is covered by the contract “For improving educational infrastructure in the municipality of Tirana in Zone 4. This contract is implemented by the concessionary company Tirana 4. The contract was signed in 2020 with the concessionary group of companies consisting of:  The Union of economic operators: Alba Konstruksion shpk, FUSHA, ED KONSTRUKSION, ERZENI/SH, SON Engineering & Construction and A & E ENGINEERING sh.p.k. For the period 2020-2023, payments envisioned as budgetary support covered by public funds for the project are estimated at 4 649 443 000 (four billion and six hundred and forty-nine million and four hundred and forty-three thousand) ALL. This project is supported through the interim tax for improving educational infrastructure, tax paid only in Tirana municipality.

Construction and operation of the access road to Yacht Port – Orikum-Dukat Bypass (St. Elise Bridge) The projected value for this contract in 2021 is 393 979 000 (three hundred and ninety-three million and nine hundred and seventy-nine thousand) ALL, or about 3% of the planned total cost for PPPs for 2021.  This contract is signed by the Ministry of Infrastructure and Energy. This concessionary contract is managed by the concessionary company “Orikum – Llogara Road”. The contract is signed in 2019 with “GJIKURIA” sh.p.k. For the 2020-2023 payments envisioned as budgetary support covered by public funds are estimated at 2 903 318 000 (two billion and nine hundred and three million and three hundred and eighteen thousand) ALL.

The construction and operation of Milot-Baldren Road is another active concessionary contract, which means costs to the budget. The projected value for this contract is 65,000 (sixty-five million) ALL.  This contract is signed by the Ministry of Infrastructure and Energy. This concessionary contract is implemented by BARDH KONSTRUKSION company. The contract is signed in 2019 with the company NK sh.p.k as the concessionary, and “BARDH KONSTRUKSION” as the concessionary company. For the period 2020-2023, payments envisioned as budgetary support covered by public funds are estimated at 1464 945 000 (one billion and four hundred and sixty-four million and nine hundred and forty-five thousand) ALL.

The construction, operation and transfer of incinerator for urban waste processing of Elbasan Municipality is the other concessionary contract to be active in 2021 and supported by public funds. The projected value for this contract is 49 124 000 (forty-nine million and one hundred and twenty-four thousand) ALL.  This contract is signed by the Ministry of Infrastructure and Energy. This concessionary contract is implemented by ALBTEK ENERGY company. The contract is signed in 2014 by the former contracting authority, the Ministry of Environment with Albtek Energy company and is amended in 2015. For the period 2018-2021, payments envisioned as budgetary support covered by public funds for the project are estimated at 2 033 626 000 (two billion and thirty-three million and six hundred and twenty-six thousand) ALL.

Passports are created in the  OpenCorporates.Al portal for every concessionary PPP company and their owners. Through the Concessionary Companies, 274 such companies can be listed and viewed (registered as of February 2020).
